Regulations Governing Issuance, Revocation, and Cancellation of Compliance Certification for Diesel and Alternative Clean Fuel Engine Vehicle Emissions Inspections

These Regulations are determined pursuant to Article 39 of the Air Pollution Control Act (herein referred to as this Act)

Article 2 [繁體中文]

Terms used in these Regulations are defined as follows:

  1. Engine family: Diesel and alternative clean fuel engines (herein referred to as diesel engines) that possess identical cylinder bore center-to-center distances, cylinder block configurations (air or water cooled, straight six cylinders, opposed type, V8, etc.), intake valve (orifice) and exhaust valve (orifice) locations, air supply method (such as turbocharger), emission control system, fuel supply system, engine air intake cooling method (such as aftercooler or intercooler) may be classed as the same engine family.

  2. Vehicle configuration: Diesel light trucks and diesel minibuses have the same vehicle configuration when their basic engines, emission control systems, gearshift devices, and inertial weight classes are identical.

  3. In-use diesel and alternative clean fuel engine motor vehicles from overseas (herein referred to as diesel vehicles): Vehicles already registered and licensed by the motor vehicle supervisory agencies of the country of import that must obtain an import and commodities tax payment (exemption) certificate issued by customs at the time of import as documentary proof.

  4. Model year: the calendar year in which the vehicle model was mass-produced by the vehicle manufacturer.

  5. On Board Diagnostics System (herein referred to as OBD) means a computer system inside the vehicle that monitors vehicle pollution control equipment and can diagnose current operating status and malfunctions, save the malfunction code, and display signal indicators when malfunctions occur.

  6. Hybrid Electric Vehicle (herein referred to as HEV) means a vehicle with an internal combustion engine and electric motor dual power source that uses diesel fuel and other alternative clean fuel engines.

Article 3 [繁體中文]

Diesel vehicles shall comply with Article 3 and Article 4 of the Vehicular Air Pollutant Emission Standards, as well as relevant stipulations of these Regulations before the central competent authority issues gasoline vehicle configuration emission test compliance certification (herein referred to as compliance certification).

Article 4 [繁體中文]

Those applying for compliance certification shall abide by the following regulations:

  1. For domestically manufactured diesel vehicles, the manufacturer shall submit applications.

  2. For imported diesel vehicles, the manufacturer's agent or association of importers and distributors shall submit applications.

  3. For imported motor vehicles procured by government organizations at all levels, said organization shall directly submit the application or commission the awarded tenderer to submit the application.

  4. For diesel vehicles individually imported from overseas, the owner shall submit the application.

Documents to be attached to an application for compliance certification, selection of a test vehicle, test fuel standards, acknowledgement of foreign compliance certification and testing reports, and other binding matters are prescribed in Appendix 1.

Article 6 [繁體中文]

The central competent authority may select a diesel vehicle that is representative from an engine family that applies for compliance certification for the said engine family's pollutant emissions and designate a competent authority authorized testing organization to perform testing. The data from said testing shall be considered official results and serve as basis for determining whether the engine family complies with emission standards.

Article 7 [繁體中文]

The central competent authority must determine whether the diesel engine used by the vehicle model complies with emission standards before an applicant may apply for heavy diesel vehicle compliance certification.

An applicant for the determination in the foregoing paragraph shall proceed pursuant to the following regulations:

  1. The diesel engine manufacturer shall submit an application for a domestically manufactured diesel engine.

  2. For imported foreign diesel engines, the manufacturer's agent or association of importers and distributors shall submit applications.

  3. For diesel engines individually imported from overseas, the owner shall submit the application.

Documents to be attached to determine compliance in Paragraph 1, selection of a test engine, test fuel standards, acknowledgement of foreign compliance certification and testing reports, and other binding matters are prescribed in Appendix 2.

When an applicant plans, in the following year, to continue manufacturing or importing diesel vehicles that have already obtained compliance certification, the applicant shall apply to the central competent authority for continued use of the compliance certification for the following model year.

Applicants may use compliance certification after the following information has been verified and approved for compliance by the central competent authority:

  1. The vehicle model is identical with that of the previous model year.

  2. All relevant items that may affect emission pollution are identical with those of the previous model year.

Article 9 [繁體中文]

Applicants making partial revisions to engine family configuration information and continuing to use the original engine family configuration shall apply with central competent authority to make the necessary revisions to the compliance certification.

The central competent authority shall issue revised compliance certification after reviewing the following information submitted by the applicant:

  1. Comparative data for the engine type before and after modification.

  2. Proof that the items affected by emissions pollution are the same;

  3. Proof that emission characteristics are identical.

When the applicant plans to add a new vehicle configuration to the same engine family, the applicant should first apply to the central competent authority for an extension of the compliance certification.

Applicants may extend compliance certification after the following information has been verified and approved for compliance by the central competent authority:

  1. Information regarding said extended vehicle model;

  2. Proof that the items affected by emissions pollution are the same;

  3. Proof that emission characteristics are identical.

Applicants shall submit all pollution control deterioration factors listed in the Vehicular Air Pollutant Emission Standards for each engine family. Deterioration factors shall be handled pursuant to Appendix 3.

Article 12 [繁體中文]

Mass production diesel vehicles for which the applicant has obtained compliance certification shall comply with the following regulations:

  1. Each mass production diesel vehicle or diesel engine shall be of the vehicle model or engine type recorded in the compliance certification. All items affecting emission air pollutants and the emission control system must be consistent with the information that was recorded at the time of application for testing compliance certification.

  2. Any manuals and explanations provided by the manufacturer or importer to agents, distributors, service workshops and vehicle owners that are related to the use, repair, adjustment, servicing or testing of emission control systems shall all be consistent with the data at the time of application for compliance certification.

  3. The manufacturer, agent designated by the manufacturer, or an association jointly composed of importers shall submit statistical analysis data from quality control testing implemented during the previous three months to the central competent authority for future reference prior to the 20th day of January, April, July, and October of each year. If a diesel vehicle or diesel engine fails to comply with emission standards in quality control testing, the reason for the failure to comply with standards and corrective measures shall be explained.

If heavy diesel vehicles are subjected to quality control testing in Subparagraph 3 of the foregoing paragraph, the central competent authority may require the testing of no less than one out of every 500 vehicles in each engine family that have been manufactured or imported. If light diesel vehicles are tested, the central competent authority may require the testing of no less than one out of every 200 vehicles in each engine family that have been manufactured or imported. The central competent authority may require the random testing of one vehicle when the number of vehicles manufactured or imported are less than the foregoing prescribed quantities.

The central competent authority may require the implementation of new vehicle random testing one or more times annually for diesel vehicles or diesel engines that have received compliance certification. The testing ratio for new vehicle random testing, the determination of test results, and other matters requiring attention are prescribed in Appendix 4.

If the central competent authority determines that test results for new vehicle random testing are not in compliance with standards, the compliance certification for the engine family or vehicle model shall be revoked or cancelled. The applicant shall, within four weeks from the day following receipt of notice, submit an improvement plan for unsold engines or car models for the model year in question. Once the central competent authority has reviewed and approved the improvement plan, the applicant shall re-apply for the engine family or car model's compliance certification. The contents and specifics of the improvement plan are listed in Appendix 4.

Applicants who do not apply for compliance certification for a diesel vehicle on the basis of model year and engine family shall submit the following documents to apply to the central competent authority for compliance certification:

  1. Diesel fuel vehicle import and commodities tax payment (exemption) certificate issued by customs

  2. Proof that the central competent authority has determined that the engine used by the diesel vehicle model complies with emission standards, a black smoke test report, or a test report from a testing organization designated by the central competent authority ndicating compliance with emission standards.

  3. Proof that the central competent authority has determined that the engine used by the diesel vehicle model complies with emission standards, a black smoke test report, or a test report from a testing organization designated by the central competent authority ndicating compliance with emission standards.

  4. Factory certification for the diesel vehicle.

For imported diesel vehicles used overseas, applicants shall submit the following documents to the central competent authority when applying for compliance certification:

  1. Application form.

  2. Diesel fuel vehicle import and commodities tax payment (exemption) certificate issued by customs

  3. A test report from a central competent authority designated testing organization indicating that the diesel vehicle complied with new vehicle testing emission standards at the time of import.

  4. Factory certification for the diesel vehicle.

The central competent authority issued compliance certification for said engine family and model year may be cancelled or revoked by the central competent authority in one of the following circumstances:

  1. Those in violation of Articles 12 and 13

  2. Those who have been determined to be non-compliant with new vehicle random test regulations

  3. Those who submit false documents with an application, report false information, or keep false records of their operations

  4. Other circumstances as determined by the central competent authority

The diesel fuel vehicle or engine exhaust gas emission testing methods and procedures, diesel fuel vehicle or engine durability testing methods and procedures, and the diesel fuel vehicle evaporative emission testing methods and procedures needed to apply for compliance certification shall be separately determined by the central competent authority.

The central competent authority may commission agencies (organizations) to handle relevant matters related to testing compliance certification review, issuance, and authorization fees, and new vehicle random testing.

Article 20 [繁體中文]

These Regulations shall take effect on the date of promulgation.

Appendix 1: Documents to be attached to an application for diesel vehicle compliance certification, selection of a test vehicle, test fuel standards, acknowledgement of foreign compliance certification and testing reports, and other binding matters

  1. When applying for diesel vehicle compliance certification (herein referred to as compliance certification), the applicant shall submit attached documents to verify to the central competent authority that the engine used by the vehicle model complies with emission standards; the central competent authority may issue a diesel vehicle compliance certification letter after determining that the engine used by that vehicle model complies with emission standards.

  2. Applying for Compliance Certification for Heavy Disesel Vehicles, Trucks

    1. Test Vehicle and Test Fuel Standards

      1. Test vehicle

        A test vehicle must comply with information stated on the vehicle manufacturer's compliance certification application. Testing shall be performed in accordance with the test method specified in Article 18 of these Regulations, and the test vehicle shall comply with all necessary conditions prescribed in this Appendix.

        1. Selection of Test Vehicles

          An applicant shall select test vehicles on the basis of engine family classification, and shall select vehicles in each engine family in accordance with the following conditions:

          1. Representative test vehicles shall be selected for each different engine type.

          2. Representative test vehicles shall be selected for each chassis and complete vehicle.

      2. Test fuel

        1. Pollution test diesel standards

          1. In compliance with US FTP Transient testing methods, engines meeting July 1, 1993 and July 1, 1999 emission standards shall be tested using fuel complying with US 1994 test fuel standards (Table 1 in this Appendix); engines meeting January 1, 2007 emission standards shall be tested using fuel complying with US 2004 test fuel design (Table 2 in this Appendix).

          2. When following testing regulations contained in European Union Directive 1999/96/EC, testing shall be performed using fuel complying with test fuel standards in that directive and subsequently revised test fuel standards (Table 3 in this Appendix).

        2. Pollution test alternative clean fuel standards

          Alternative clean fuel used in pollution testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. However, the manufacturer must guarantee that when accepting on-sale goods in domestic use for random pollution testing of new vehicles, such fuel shall still comply with the ROC's emission standard regulations. Standards governing foreign on-sale fuel may be employed when there is no on-sale fuel in the ROC.

    2. An applicant shall provide a Chinese user manual containing an emission control system warranty to the central competent authority for future reference. The manual shall contain a detailed account of maintenance regulations, and shall clearly specify inspection items and parts requiring replacement during the warranty period so as to facilitate scheduled maintenance by the vehicle owner using the manual and ensure that the emission control systems of diesel vehicles and engines function normally within the effective use period.

    3. Warranty period

      1. The pollutant emissions of diesel vehicles shall comply with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards during the warranty period when in normal maintenance and use.

      2. The diesel motor vehicle emission control system warranty period shall be as prescribed in Article 5 of the Vehicular Air Pollutant Emission Standards.

      3. The warranty period of those complying with relevant testing regulations and subsequently revised regulations of EU Directive 1999/69/EC shall be determined pursuant to the aforesaid Directive and subsequent revisions.

    4. Diesel vehicles may not be equipped with defeat devices. However, defeat devices that possess the following functions shall not be subject to this restriction:

      1. Necessary functions able to protect the diesel vehicle by preventing damage or accidents

      2. Functions no longer activated after the engine has started and the vehicle has warmed up

    5. Testing and inspection

      1. When an applicant applies for a compliance certification letter, the central competent authority may request that the applicant select at least one vehicle or engine and bring the vehicle(s) or engine(s) to the location designated by the central competent authority for testing; the applicant shall bear responsibility for all necessary expenses.

      2. When a vehicle manufacturer applies for a diesel vehicle compliance certification letter, central competent authority personnel may enter the applicant's testing laboratory and factory, review the applicant's relevant records, determine whether the test vehicles and mass production vehicles meet the requirements of these Regulations, and thereby confirm whether the vehicles comply with design standards stated at the time of application.

      3. When a vehicle manufacturer actually implements procedures needed for the applied-for testing, the central competent authority may send personnel to oversee or inspect the preparation process. The central competent authority may also designate a professional testing organization to jointly perform oversight and inspection work in conjunction with the central competent authority.

    6. Testing standards and test report

      1. Testing standards

        Instrument testing of the black smoke pollution percentage of heavy diesel busses and trucks shall comply with the diesel vehicle exhaust smoke testing methods specified in ROC national standards CNS11644 (diesel vehicle unloaded extreme acceleration exhaust smoke testing method) and CNS11645 (diesel vehicle full load fixed rpm exhaust smoke testing method).

      2. Test report

        The applicant shall provide test reports for heavy diesel busses and trucks in accordance with the testing methods specified in CNS11644 and CNS11645.

    7. Emission black smoke quality control plans for heavy diesel busses and trucks at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 500 heavy diesel vehicles of each vehicle type shall be subjected to random testing.

    8. Applying for Compliance Certification for Heavy Disesel Vehicles, Trucks

      1. Two Steps in Applying for Compliance Certification for Heavy Diesel Vehicles, Trucks:
        1. Application for a heavy diesel vehicle engine family exhaust compliance certification letter (herein referred to as compliance certification letter)

        2. Application for compliance certification

      2. Applicants that fall under one of the following categories may concurrently submit the applications listed in Article 2, Paragraph 8, Subparagraph 1 of this Appendix:
        1. Manufacturers of diesel fuel engines that also manufacture vehicles

        2. A designated agent for a manufacturer of diesel fuel engines that is also a designated agent for an enterprise that imports vehicles (or manufactures vehicles domestically)

      3. Applicants that have already obtained a compliance certification letter issued by the central competent authority (or a letter of guarantee and a photocopy of the letter of consent and compliance certification letter from the original holder of the compliance certification) and whose black smoke emissions score for the vehicle model's engine family (the score for which is based on the Diesel Motor Vehicles Exhaust Emissions Testing Methods and Procedures) is in compliance with Article 5 of the Vehicular Air Pollutant Emission Standards, shall apply for diesel vehicle compliance certification with the central competent authority.
    9. Applying for Compliance Certification for Heavy Disesel Vehicles, Trucks

      Application qualifications

      1. A domestic manufacturer shall submit an application for a domestic vehicle, and shall provide proof of service and maintenance ability and a vehicle emission air pollutant quality control plan. An applicant may commission a central competent authority designated professional testing organization to implement the vehicle emission air pollutant quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

      2. If the foreign engine manufacturer of an imported diesel vehicle designates a domestic agent to apply on its behalf, the applicant shall submit proof of service and maintenance ability and a vehicle emission air pollutant quality control plan.An applicant may commission a central competent authority designated professional testing organization to implement the vehicle emission air pollutant quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

      3. An applicant not covered by the foregoing Paragraph 1 or 2 (an industry association shall submit an application on behalf of a constituent importer) shall submit a test report provided by a central competent authority designated inspection organization in accordance with regulations in Article 2, Paragraph 6 of this Appendix, and proof of service and maintenance ability. Such an applicant may commission a central competent authority approved testing organization to implement vehicle emission air pollutant quality control plan on its behalf, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

    10. Issuance of Compliance Certification for Heavy Disesel Vehicles, Trucks

      1. The central competent authority shall issue diesel vehicle compliance certification solely for one model year.

      2. The compliance certification issued for each diesel vehicle type shall state formal emission test results (including gaseous pollutants, particulate pollutants, and black smoke).

    11. Continued use of heavy diesel vehicle and truck compliance certification

      1. An applicant may re-submit a reviewed and approved compliance certification application for a domestic previous model year diesel vehicle.

      2. A manufacturer holding diesel vehicle compliance certification shall submit design elements connected with pollution emissions for that diesel vehicle to the central competent authority on an annual basis.

    12. Modification of a heavy diesel vehicle or truck that has received compliance certification

      1. An applicant holding compliance certification shall notify the central competent authority in advance if the vehicle manufacturer modifies the emission control system or emission-related parts or devices on a vehicle it manufacturers.

      2. The central competent authority may request the testing of a modified vehicle in order to determine whether the original compliance certification may still be used for that vehicle.

      3. If the central competent authority determines that the original diesel vehicle compliance certification can be used for that vehicle, it shall notify the applicant in writing.If the central competent authority determines that the original diesel vehicle compliance certification cannot be used for the modified vehicle, the modified vehicle shall be considered a new vehicle model, and the case shall be handled in accordance with the compliance certification extension regulations in Article 10 of these Regulations.

    13. Extension of heavy diesel vehicle and truck compliance certification

      1. An applicant planning to add a new vehicle model to the same engine family shall first apply to the central competent authority in writing for extension of the diesel vehicle compliance certification.

      2. With regard to the application in the forgoing Paragraph 1, central competent authority may, when necessary, designate (or allow the applicant to select on its own) a sufficiently representative vehicle model for instrument black smoke testing as prescribed in Article 5 of the Vehicular Air Pollutant Emission Standards.

    14. Applicants of compliance certification for heavy passenger diesel vehicles or diesel fuel trucks shall append the following documents and proceed pursuant to the regulations of the central competent authority:

      1. Application letter (including a seal impression card)

      2. Review form

      3. Diesel vehicle compliance certification draft

      4. Chinese vehicle specification table

      5. A photocopy of the compliance certification letter (or a letter of guarantee and a photocopy of the letter of consent and compliance certification letter from the original holder of the compliance certification)

      6. Photocopy of diesel vehicle exhaust smoke test report

      7. Single photographs (including four sides, engine, driver's compartment, chassis)

      8. Label

      9. If complying with the regulations of Article 2, Paragraph 9, Subparagraph 2 of this Appendix, the original manufacturer shall state that the air pollution emission values of the vehicle type are identical with those of the original foreign vehicle type, and comply fully with the laws and regulations of the ROC; this statement shall bear the signature or seal of the manufacturer's authorized statutory responsible person.

      10. The vehicle manufacturer's letter of authorization authorizing its domestic agent. The letter of authorization shall grant the domestic agent full power to represent that vehicle manufacturer, allowing it to apply for diesel and alternative clean fuel engine vehicle type exhaust compliance certification. Both parties must comply fully with relevant laws and regulations.The domestic agent must also prove that it bears identical obligations with the vehicle manufacturer.When there is no letter of authorization from the vehicle manufacturer, an association jointly composed of importers may submit an application, and shall attach a guarantee vouching that it bears identical obligations with the vehicle manufacturer.

      11. New vehicle random testing guarantee

      12. Import and commodities tax payment (exemption) certificate issued by customs

      13. Emission black smoke quality control plans for heavy diesel busses and trucks at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 500 heavy diesel vehicles and trucks of each vehicle type shall be subjected to random testing.

      14. Operating manual (shall include emission control system warranty, and clearly specify inspection items and parts requiring replacement during the warranty period)

    15. Other regulations

      1. The application and appended documents for compliance certification shall be in Chinese or English. Foreign automakers that have documents in a language other than Chinese or English shall provide a Chinese translation of these documents. These documents must bear the signature or seal of the authorized statutory responsible person. Recently updated information shall also be submitted.

      2. The vehicle manufacturer shall comply with all applicable regulations in order to demonstrate compliance with emission standards.

      3. An applicant shall preserve the most recent documents recording data and test results; said records shall be preserved for five years from the date of issuance of the compliance certification letter.

  3. Applying for Compliance Certification for Light Diesel Trucks

    1. Deterioration factors must be submitted with an application for light diesel truck compliance certification; deterioration factors shall be determined as prescribed in Article 11 of these Regulations.

    2. Test Vehicle and Test Fuel Standards

      1. Test vehicle

        A test vehicle must comply with information stated on the vehicle manufacturer's compliance certification application. Testing shall be performed in accordance with the test method specified in Article 18 of these Regulations, and the test vehicle shall comply with all necessary conditions prescribed in this Appendix.

        1. Selection of Test Vehicles

          An applicant shall select test vehicles on the basis of engine family classification, and shall select vehicles in each engine family in accordance with the following conditions:

          1. First test vehicle

            Select the vehicle with the greatest load weight. If the greatest load weights are identical, select the vehicle with the greatest drag resistance (calculated at a speed of 80 kilometers per hour).If the greatest drag resistance is identical, select the vehicle with the greatest engine displacement.If the greatest engine displacements are identical, select the vehicle with the highest total gear ratio.

          2. Second test vehicle

            If the first test vehicle cannot represent the highest exhaust emission value of that vehicle configuration, a second test vehicle must be selected.

            The central competent authority may select at least one vehicle in any one vehicle configuration to serve as test vehicles if the test vehicles selected by the foregoing method cannot represent each vehicle configuration.

        2. Endurance test vehicles

          The applicant may select one representative vehicle in each engine family for endurance testing. The central competent authority must review and agree to the choice of endurance test vehicle and endurance test plan, and the applicant shall provide endurance testing results for each stage to the central competent authority in a timely manner in accordance with the plan.

      2. Test fuel

        1. Pollution test diesel standards

          1. Pollution test diesel standards

            1. a. Those in compliance with the US government's FTP-75 (Federal Test Procedure) and January 1, 2004, emission standards shall adhere to US 2004 Test Fuel Standards (for details see Table 1 of this Appendix); those in compliance with January 1, 2007, emission standards (or subsequent emission standards promulgated after this date) shall adhere to US 2004 Test Fuel Standards (for details see Table 2 of this Appendix).
            2. b. Those in compliance with relevant emission testing regulations and subsequent revisions of EU Directive 98/69/EC shall adhere to the Directive's test fuel standards and subsequent revisions.
          2. Pollution test alternative clean fuel standards

            Alternative clean fuel used in pollution testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. However, the manufacturer must guarantee that when accepting on-sale goods in domestic use for random pollution testing of new vehicles, such fuel shall still comply with the ROC's emission standard regulations. Standards governing foreign on-sale fuel may be employed when there is no on-sale fuel in the ROC.

        2. Pollution test diesel standards

          1. Pollution test diesel standards

            Durability testing for diesel fuel shall use the standards for premium diesel fuel for sale on Taiwan's domestic market as the norm and select fuel for sale on domestic markets overseas. If several types of fuel are available on domestic markets overseas, the type nearest to the standards for premium diesel fuel for sale on Taiwan's domestic market shall be selected for testing.

          2. Endurance test alternative clean fuel standards

            Alternative clean fuel used for endurance testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. When there are neither domestic nor foreign standards, the fuel shall comply with standards governing domestic on-sale fuel. If there is no domestic on-sale fuel, the fuel may comply with standards governing foreign on-sale fuel.

      3. An applicant shall provide a Chinese user manual containing an emission control system warranty to the central competent authority for future reference. The manual shall contain a detailed account of maintenance regulations, and shall clearly specify inspection items and parts requiring replacement during the warranty period so as to facilitate scheduled maintenance by the vehicle owner using the manual and ensure that the emission control systems of diesel vehicles and engines function normally within the effective use period.

      4. Labels

        1. The manufacturer shall affix a durable, corrosion-resistant, rust-proof, clearly-legible English label not likely to fall off to import vehicles in accordance with the exhaust control regulations of the country where the plant is located. The content and location of this label shall comply with the regulations of the country where the plant is located.If the exhaust control regulations of the country where the plant is located do not prescribe the attachment of an English label, an import vehicle from that country is not required to bear an English label.

        2. An applicant that has received compliance certification shall affix an additional, Chinese label to the vehicle or engine. This label shall be affixed in such a manner as to be destroyed or rendered illegible when removed from the vehicle or engine.

        3. The Chinese text of the label shall include the following information:

          1. The title of the label shall be "Vehicle Emissions Control Data".

          2. The full name of the company and trademark of the vehicle manufacturer

          3. Name of the engine family, engine displacement, emission control system, and identification of the model year

          4. The engine's optimal adjustment specifications and adjustment methods, which shall include at least the injection timing and valve clearance.

          5. The following shall be stated clearly: "The vehicle model of this engine family is in compliance with the ROC diesel vehicle emission standards promulgated on January 1, 2004 (or subsequent emission standards promulgated after this date)."

          6. A diagram showing the location of all air pollution control equipment specified in the label

      5. Warranty period

        1. The pollutant emissions of diesel vehicles shall comply with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards during the warranty period when in normal maintenance and use.

        2. The diesel motor vehicle emission control system warranty period shall be as prescribed in Article 5 of the Vehicular Air Pollutant Emission Standards.

      6. Diesel vehicles may not be equipped with defeat devices. However, defeat devices that possess the following functions shall not be subject to this restriction:

        1. Necessary functions able to protect the diesel vehicle by preventing damage or accidents

        2. Functions no longer activated after the engine has started and the vehicle has warmed up

      7. Testing and inspection

        1. When an applicant applies for a compliance certification letter, the central competent authority may request that the applicant select at least one vehicle and bring the vehicle(s) to the location designated by the central competent authority for testing; the applicant shall bear responsibility for all necessary expenses.

        2. When a vehicle manufacturer applies for a compliance certification letter, central competent authority personnel may enter the applicant's testing laboratory and factory, review the applicant's relevant records, determine whether the test vehicles and mass production vehicles meet the requirements of these Regulations, and thereby confirm whether the vehicles comply with design standards stated at the time of application.

        3. When a vehicle or engine manufacturer actually implements procedures needed to apply for testing, the central competent authority may send personnel to oversee or inspect the preparation process. The central competent authority may also designate a professional testing organization to jointly perform oversight and inspection work in conjunction with the central competent authority.

      8. Testing standards and test report

        1. Testing standards

          1. Light diesel trucks with gross vehicle weight (GVW) less than or equal to 2,500 kilograms shall be subjected to vehicle body dynamometer testing in accordance with the FTP-75 testing method.

          2. Light diesel trucks with a GVW greater than 2,500 kilograms and less than or equal to 3,500 kilograms may be tested in accordance with either the FTP-75 testing method or the FTP Transient testing method; a test report shall be provided.

          3. Instrument testing of the black smoke pollution percentage of light diesel trucks shall comply with the diesel vehicle exhaust smoke testing methods specified in ROC national standards CNS11644 (diesel vehicle unloaded extreme acceleration exhaust smoke testing method) and CNS11645 (diesel vehicle full load fixed rpm exhaust smoke testing method).

        2. Test report

          1. For light diesel trucks whose gross vehicle weight is less than or equal to 2,500kg, the manufacturer or importer must provide an FTP-75 test report.

            1. When a light diesel truck is in compliance with January 1, 2007, emission standards (or subsequent emission standards promulgated after this date), the applicant shall provide an explanation of the light diesel truck emission standard compliance as a substitute for the HCHO emissions testing regulations.However, the basis of the foregoing statement shall be the emissions test, driving test and other appropriate information.
            2. NMOG (non-methane organic gas) testing for light diesel trucks may only measure NMHC multiplied by 1.0 (conversion factor) to calculate the NMOG control standard.

          2. If the gross vehicle weight of the light diesel truck is greater than 2,500kg and less than or equal to 3,500kg, the manufacturer or importer must provide either an FTP-75 test report or an FTP Transient test report.

          3. Those adhering to EU directives for N1-class vehicles with a gross vehicle weight less than or equal to 3,500kg shall comply with the test methods and test report standards of either EU Directive 98/69/EC and subsequent revisions or EU Directive 1999/96/EC and subsequent revisions.

          4. A test report as described in the testing methods of the Diesel Motor Vehicles Exhaust Emissions Testing Methods and Procedures shall be provided for all light diesel trucks.
      9. Emission black smoke quality control plans for light diesel trucks at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 200 light diesel trucks shall be subjected to random testing.

      10. Engine family

        1. Engines for which applications have been made for diesel motor vehicle compliance certification shall be classed on the basis of similar emission characteristics. Each class shall be defined as a separate engine family, and each engine family shall require a separate compliance certification application.

          Engines belong to the same engine family when the following relevant items are all identical:

          1. Cylinder bore center-to-center distance

          2. Cylinder block configuration (air- or water-cooled, L-6, 90°, or V-8, etc.)

          3. Intake and exhaust valve (or orifice) locations

          4. Air supply method (turbocharger)

          5. Pollution control system

          6. Fuel supply system

          7. Engine intake air cooling method (such as aftercooler or intercooler)

        2. If the central competent authority deems that an engine may have different emission characteristics even though the foregoing items are all identical, the central competent authority may classify that engine in a different engine family.The following engine characteristics shall be considered when making this type of decision:

          1. Cylinder bore and stroke

          2. Ratio of cylinder surface area to volume when engine is at the dead point

          3. Intake manifold orifice size and configuration

          4. Exhaust manifold orifice size and configuration

          5. Intake and exhaust valve sizes

          6. Camshaft and injection timing characteristics

        3. Standard engine family naming method

          1. Reason for standardized naming of engine families

            Standardized names make it easier to identify the model year and manufacturer of an engine family, and provide basic information concerning that engine family.Standardized name can also facilitate the testing process, and lessen errors made keying information into databases.Standard engine family names consist of a string of alphanumeric characters, and each character has its own specific meaning.

          2. Standard engine family names

            Standard engine family names consist of 11 alphanumeric characters, and have the following structure and representative meaning:

        4. Use of engine family naming method

          An extra code may be appended to the original applied for engine family name when continuing to use an engine family name.

          1. Example

            If it is wished to continue to use an original engine family name of 2********** during the 2003 model year, the new name shall be 2**********-A3.The codes appended for different model years are as shown in Table 8 of this Appendix.

        5. Enterprises that do not adopt the Standard Engine Family Naming Method in Article 4, Paragraph 10, Subparagraph 3 of this Appendix for light diesel trucks shall produce an 11-digit identification code for the engine family. However, the first digit of the identification code (Model Year Code) and those adopting the Standard Engine Family Naming Method must still comply with Article 4, Paragraph 10, Subparagraphs 3 and 4 of this Appendix.
      11. Applying for Compliance Certification for Light Diesel Trucks

        1. Application qualifications

          1. A domestic manufacturer shall submit an application for a domestic vehicle, and shall provide proof of service and maintenance ability and emission air pollutant quality control plan for light diesel vehicles. The applicant may commission a central competent authority designated professional testing organization or laboratory complying with the regulations of Article 3, Paragraph 11, Subparagraph 2, Item 2 of this Appendix to implement the quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

          2. If the foreign engine manufacturer of an imported diesel vehicle designates a domestic agent to apply on its behalf, the applicant shall submit proof of service and maintenance ability and a emission air pollutant quality control plan for light diesel vehicles.The applicant applying for an imported vehicle may commission a central competent authority designated professional testing organization or laboratory complying with the regulations of Article 3, Paragraph 11, Subparagraph 2, Item 2 of this Appendix to implement the quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

          3. An applicant not covered by the foregoing Items 1 or 2 (an industry association shall submit an application on behalf of a constituent importer) shall submit a test report provided by a central competent authority designated inspection organization in accordance with regulations in Article 3, Paragraph 8 of this Appendix, and proof of service and maintenance ability. Such an applicant may commission a central competent authority approved testing organization to implement vehicle emission air pollutant quality control plan for light diesel vehicles on its behalf, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

        2. Application Method

          1. Application method for compliance certification from a country designated by the central competent authority

            1. If an applicant has received new vehicle model compliance certification issued by the US EPA after the vehicle has passed FTP-75 testing, and the exhaust certification value complies with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards, the applicant may apply to the central competent authority for a compliance certification letter.

            2. Applicants that have obtained N1-class compliance certification issued by an EU member country based on EU Directive 98/69/EC and subsequent revisions, and whose emissions score complies with Article 5 of the Vehicular Air Pollutant Emission Standards, shall apply for light truck compliance certification with the central competent authority.
          2. Application method for compliance certification from a country not designated by the central competent authority

            If an applicant has received a test report from a laboratory meeting the following laboratory qualifications, the applicant may apply to the central competent authority for a compliance certification letter:

            1. The laboratory has received diesel vehicle new vehicle model compliance certification issued by the US EPA after performing US FTP-75 testing, and the evidence is sufficient to verify that the laboratory possesses FTP-75 equipment and testing capabilities, and that the US EPA has accepted test values from the laboratory.

            2. For those that have obtained N1-class new type vehicle testing certification issued by an EU member country based on EU Directive 98/69/EC and subsequent revisions, this testing certification is sufficient evidence that the testing equipment and capabilities in the laboratory conform to the testing standards of EU Directive 98/69/EC and subsequent revisions and the test scores have been accepted by EU member countries.

            3. Those that are not in compliance with items (a) or (b) in the foregoing paragraph must, through a professional testing organization authorized by the central competent authority or a globally recognized testing organization approved by the central competent authority, provide certification that the testing equipment and capabilities in the laboratory conform to the testing standards of EU Directive 98/69/EC and subsequent revisions. The test values used in the laboratory may only be those deemed acceptable by the central competent authority.
      12. Issuance of Compliance Certification for Light Diesel Trucks

        1. The central competent authority shall issue light diesel truck compliance certification solely for one model year.

        2. The compliance certification issued for each light diesel truck type shall state formal emission test results (including gaseous pollutants, particulate pollutants, and black smoke).

      13. Continued use of light diesel truck compliance certification

        1. An applicant may re-submit a reviewed and approved compliance certification application for a domestic vehicle of a previous model year.

        2. A manufacturer holding light diesel truck compliance certification shall submit design elements connected with pollution emissions for the said vehicle to the central competent authority on an annual basis.

      14. Modification of a light diesel truck that has received compliance certification

        1. An applicant holding compliance certification shall notify the central competent authority in advance if the vehicle manufacturer modifies the emission control system or emission-related parts or devices on a vehicle it manufacturers.

        2. The central competent authority may request the testing of a modified vehicle in order to determine whether the original compliance certification may still be used for that vehicle.

        3. If the central competent authority determines that the original light diesel truck compliance certification can be used for that vehicle, it shall notify the applicant in writing.If the central competent authority determines that the original light diesel truck compliance certification cannot be used for the modified vehicle, the modified vehicle shall be considered a new vehicle model, and the case shall be handled in accordance with the compliance certification extension regulations in Article 10 of these Regulations.

      15. Extension of light diesel truck compliance certification

        1. An applicant planning to add a new vehicle model configuration or vehicle model to the same engine family shall first apply to the central competent authority in writing for extension of the light diesel truck compliance certification.

        2. For the application in the foregoing paragraph, the central competent authority may, when necessary, designate (or allow the applicant to select on its own) a sufficiently representative vehicle model for testing as prescribed in regulations.

      16. Applicants of compliance certification for light diesel trucks shall append the following documents and proceed pursuant to the regulations of the central competent authority:

        1. Application letter (including a seal impression card)

        2. Review form

        3. Diesel vehicle compliance certification draft

        4. Chinese vehicle specification table

        5. Light Diesel and Alternative Clean Fuel Engine Compliance Certification Application Form (See Table 10 of this Appendix)

        6. Photocopy of diesel vehicle exhaust smoke test report

        7. Single photographs (including four sides, engine, driver's compartment, chassis)

        8. Label

        9. If complying with the regulations of Article 3, Paragraph 11, Subparagraph 1 of this Appendix, the original manufacturer shall state that the air pollution emission values of the vehicle type are identical with those of the original foreign vehicle type, and comply fully with the laws and regulations of the ROC; this statement shall bear the signature or seal of the manufacturer's authorized statutory responsible person.

        10. The vehicle manufacturer's letter of authorization authorizing its domestic agent. The letter of authorization shall grant the domestic agent full power to represent that vehicle manufacturer, allowing it to apply for light diesel truck compliance certification. Both parties must comply fully with relevant laws and regulations.The domestic agent must also prove that it bears identical obligations with the vehicle manufacturer.When there is no letter of authorization from the vehicle manufacturer, an association jointly composed of importers may submit an application, and shall attach a guarantee vouching that it bears identical obligations with the vehicle manufacturer.

        11. New vehicle random testing guarantee

        12. Import and commodities tax payment (exemption) certificate issued by customs

        13. Emission black smoke quality control plans for light diesel trucks at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 200 light diesel trucks shall be subjected to random testing.

        14. Operating manual (shall include emission control system warranty, and clearly specify inspection items and parts requiring replacement during the warranty period)

        15. Light trucks in compliance with relevant testing regulations and subsequently revised regulations of EU Directive 98/96/EC shall also be equipped with an OBD system and all documents required by the Directive shall be appended pursuant to the Directive and subsequent revisions.
      17. Other regulations

        1. The application and appended documents for compliance certification shall be in Chinese or English. Foreign automakers that have documents in a language other than Chinese or English shall provide a Chinese translation of these documents. These documents must bear the signature or seal of the authorized statutory responsible person. Recently updated information shall also be submitted.

        2. The vehicle manufacturer shall comply with all applicable regulations in order to demonstrate compliance with emission standards.

        3. An applicant shall preserve the most recent documents recording data and test results; said records shall be preserved for five years from the date of issuance of the compliance certification letter.

  4. Applying for Compliance Certification for Minibuses

    1. Deterioration factors must be submitted with an application for minibus compliance certification; deterioration factors shall be determined as prescribed in Article 11 of these Regulations.

    2. Test Vehicle and Test Fuel Standards

      1. Test vehicle

        A test vehicle must comply with information stated on the vehicle manufacturer's compliance certification application. Testing shall be performed in accordance with the test method specified in Article 18 of these Regulations, and the test vehicle shall comply with all necessary conditions prescribed in this Appendix.

        1. Selection of Test Vehicles

          An applicant shall select test vehicles on the basis of engine family classification, and shall select vehicles in each engine family in accordance with the following conditions:

          1. First test vehicle

            Select the vehicle with the greatest load weight. If the greatest load weights are identical, select the vehicle with the greatest drag resistance (calculated at a speed of 80 kilometers per hour).If the greatest drag resistance is identical, select the vehicle with the greatest engine displacement.If the greatest engine displacements are identical, select the vehicle with the highest total gear ratio.

          2. Second test vehicle

            If the first test vehicle cannot represent the highest exhaust emission value of that vehicle configuration, a second test vehicle must be selected.

            The central competent authority may select at least one vehicle in any one vehicle configuration to serve as test vehicles if the test vehicles selected by the foregoing method cannot represent each vehicle configuration.

        2. Endurance test vehicles

          The applicant may select one representative vehicle in each engine family for endurance testing. The central competent authority must review and agree to the choice of endurance test vehicle and endurance test plan, and the applicant shall provide endurance testing results for each stage to the central competent authority in a timely manner in accordance with the plan.

      2. Test fuel

        1. Pollution test diesel standards

          1. Pollution test diesel standards

            1. Those in compliance with the US government's FTP-75 (Federal Test Procedure) and January 1, 2004, emission standards shall adhere to US 2004 Test Fuel Standards (for details see Table 1 of this Appendix); those in compliance with January 1, 2007, emission standards (or subsequent emission standards promulgated after this date) shall adhere to US 2004 Test Fuel Standards (for details see Table 2 of this Appendix).

            2. When following testing regulations contained in European Union Directive 98/69/EC, testing shall be performed using fuel complying with test fuel standards in that directive and subsequently revised test fuel standards (Table 3 in this Appendix).

          2. Pollution test alternative clean fuel standards

            Alternative clean fuel used in pollution testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. However, the manufacturer must guarantee that when accepting on-sale goods in domestic use for random pollution testing of new vehicles, such fuel shall still comply with the ROC's emission standard regulations. Standards governing foreign on-sale fuel may be employed when there is no on-sale fuel in the ROC.

The central competent authority may also designate a professional testing organization to jointly perform oversight and inspection work in conjunction with the central competent authority.

    8. Testing standards and test report

      1. Testing standards

        1. Diesel minibuses with a gross vehicle weight greater than 3,500kg must undergo FTP-75 testing within engine dynamometer testing, or undergo testing in compliance with the test methods of EU Directive 98/69/EC and subsequent revisions.

        2. Instrument testing of the black smoke pollution percentage of diesel minibuses shall comply with the diesel vehicle exhaust smoke testing methods specified in ROC national standards CNS11644 (diesel vehicle unloaded extreme acceleration exhaust smoke testing method) and CNS11645 (diesel vehicle full load fixed rpm exhaust smoke testing method).

      2. Test report

        1. If the gross vehicle weight of a diesel minibus is less than or equal to 3,500kg, the applicant must provide either an FTP-75 test report or a test report in compliance with the test methods and test report standards of EU Directive 98/69/EC and subsequent revisions.

          1. When a light diesel minibus is in compliance with January 1, 2007, emission standards (or subsequent emission standards promulgated after this date), the applicant shall provide an explanation of the light diesel truck emission standard compliance as a substitute for the HCHO emissions testing regulations.However, the basis of the foregoing statement shall be the emissions test, driving test and other appropriate information.
          2. NMOG (non-methane organic gas) testing for light diesel minibuses may only measure NMHC multiplied by 1.0 (conversion factor) to calculate the NMOG control standard.
        2. A test report as described in the testing methods of the Diesel Motor Vehicles Exhaust Emissions Testing Methods and Procedures shall be provided for all diesel minibuses.

    9. Emission black smoke quality control plans for diesel minibuses at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 200 diesel minibuses shall be subjected to random testing.

    10. Engine family

      1. Engines for which applications have been made for diesel motor vehicle compliance certification shall be classed on the basis of similar emission characteristics. Each class shall be defined as a separate engine family, and each engine family shall require a separate compliance certification application.

        Engines belong to the same engine family when the following relevant items are all identical:

        1. Cylinder bore center-to-center distance

        2. Cylinder block configuration (air- or water-cooled, L-6, 90° Celsius, or V-8).

        3. Intake and exhaust valve (or orifice) locations

        4. Air supply method (turbocharger)

        5. Pollution control system

        6. Fuel supply system

        7. Engine intake air cooling method (such as aftercooler or intercooler)

      2. If the central competent authority deems that an engine may have different emission characteristics even though the foregoing items are all identical, the central competent authority may classify that engine in a different engine family.The following engine characteristics shall be considered when making this type of decision:

        1. Cylinder bore and stroke

        2. Ratio of cylinder surface area to volume when engine is at the dead point

        3. Intake manifold orifice size and configuration

        4. Exhaust manifold orifice size and configuration

        5. Intake and exhaust valve sizes

        6. Camshaft and injection timing characteristics

      3. Standard engine family naming method

        1. Reason for standardized naming of engine families

          Standardized names make it easier to identify the model year and manufacturer of an engine family, and provide basic information concerning that engine family.Standardized name can also facilitate the testing process, and lessen errors made keying information into databases.Standard engine family names consist of a string of alphanumeric characters, and each character has its own specific meaning.

        2. Standard engine family names

          Standard engine family names consist of 11 alphanumeric characters, and have the following structure and representative meaning:

      4. Use of engine family naming method

        An extra code may be appended to the original applied for engine family name when continuing to use an engine family name.

        1. Example

          If it is wished to continue to use an original engine family name of 2********** during the 2003 model year, the new name shall be 2**********-A3.The codes appended for different model years are as shown in Table 8 of this Appendix.

      5. Enterprises that do not adopt the Standard Engine Family Naming Method in Article 4, Paragraph 10, Subparagraph 3 of this Appendix for diesel minibuses shall produce an 11-digit identification code for the engine family. However, the first digit of the identification code (Model Year Code) and those adopting the Standard Engine Family Naming Method must still comply with Article 4, Paragraph 10, Subparagraphs 3 and 4 of this Appendix.

    11. Applying for Compliance Certification for Diesel Minibuses

      1. Application qualifications

        1. A domestic manufacturer shall submit an application for a domestic vehicle, and shall provide proof of service and maintenance ability and emission air pollutant quality control plan for diesel minibuses. The applicant may commission a central competent authority designated professional testing organization or laboratory complying with the regulations of Article 4, Paragraph 11, Subparagraph 2 of this Appendix to implement the quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

        2. If the foreign engine manufacturer of an imported diesel minibus designates a domestic agent to apply on its behalf, the applicant shall submit proof of service and maintenance ability and a emission air pollutant quality control plan for diesel minibus vehicles.The applicant applying for an imported vehicle may commission a central competent authority designated professional testing organization or laboratory complying with the regulations of Article 4, Paragraph 11, Subparagraph 2, Item 2 of this Appendix to implement the quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

        3. An applicant not covered by the foregoing Items 1 or 2 (an industry association shall submit an application on behalf of a constituent importer) shall submit a test report provided by a central competent authority designated inspection organization in accordance with regulations in Article 4, Paragraph 8 of this Appendix, and proof of service and maintenance ability. Such an applicant may commission a central competent authority approved testing organization to implement vehicle emission air pollutant quality control plan for diesel minibuses on its behalf, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

      2. Application Method

        1. Application method for compliance certification from a country designated by the central competent authority

          1. If an applicant has received new vehicle model compliance certification issued by the US EPA after the vehicle has passed FTP-75 testing, and the exhaust certification value complies with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards, the applicant may apply to the central competent authority for a compliance certification letter.

          2. Applicants that have obtained M1-class compliance certification issued by an EU member country based on EU Directive 98/69/EC and subsequent revisions, and whose emissions score complies with Article 5 of the Vehicular Air Pollutant Emission Standards, shall apply for diesel minibus compliance certification with the central competent authority.

        2. Application method for compliance certification from a country not designated by the central competent authority

          If an applicant has received a test report from a laboratory meeting the following laboratory qualifications, the applicant may apply to the central competent authority for a compliance certification letter:

          1. The laboratory has received diesel minibus new vehicle model compliance certification issued by the US EPA after performing US FTP-75 testing, and the evidence is sufficient to verify that the laboratory possesses FTP-75 equipment and testing capabilities, and that the US EPA has accepted test values from the laboratory.

          2. For those that have obtained M1-class new type diesel minibus testing certification issued by an EU member country based on EU Directive 98/69/EC and subsequent revisions, this testing certification is sufficient evidence that the testing equipment and capabilities in the laboratory conform to the testing standards of EU Directive 98/69/EC and subsequent revisions and the test scores have been accepted by the EU member countries.

          3. Those that are not in compliance with items (a) or (b) in the foregoing paragraph must, through a professional testing organization authorized by the central competent authority or a globally recognized testing organization approved by the central competent authority, provide certification that the testing equipment and capabilities in the laboratory conform to the testing standards of EU Directive 98/69/EC and subsequent revisions. The test values used in the laboratory may only be those deemed acceptable by the central competent authority.

    12. Issuance of Compliance Certification for Diesel Minibuses

      1. The central competent authority shall issue diesel minibus compliance certification solely for one model year.

      2. The compliance certification issued for each diesel minibus type shall state formal emission test results (including gaseous pollutants, particulate pollutants, and black smoke).

    13. Continued use of diesel minibus compliance certification

      1. An applicant may re-submit a reviewed and approved compliance certification application for a domestic vehicle of a previous model year.

      2. A manufacturer holding diesel minibus compliance certification shall submit design elements connected with pollution emissions for that diesel minibus to the central competent authority on an annual basis.

    14. Modification of a diesel minibus that has received compliance certification

      1. An applicant holding compliance certification shall notify the central competent authority in advance if the vehicle manufacturer modifies the emission control system or emission-related parts or devices on a vehicle it manufacturers.

      2. The central competent authority may request the testing of a modified vehicle in order to determine whether the original compliance certification may still be used for that vehicle.

      3. If the central competent authority determines that the original diesel minibus compliance certification can be used for that vehicle, it shall notify the applicant in writing.If the central competent authority determines that the original diesel minibus compliance certification cannot be used for the modified vehicle, the modified vehicle shall be considered a new vehicle model, and the case shall be handled in accordance with the compliance certification extension regulations in Article 10 of these Regulations.

    15. Extension of diesel minibus compliance certification

      1. An applicant planning to add a new vehicle model configuration or vehicle model to the same engine family shall first apply to the central competent authority in writing for extension of the diesel minibus compliance certification.

      2. For the application in the foregoing paragraph, the central competent authority may, when necessary, designate (or allow the applicant to select on its own) a sufficiently representative vehicle model for testing as prescribed in regulations.

    16. Acknowledgement of EU Directive 98/69/EC regulations

      1. Starting from January 1, 2004, an applicant may apply for diesel minibus compliance certification in the ROC when holding an EU diesel minibus vehicle type compliance certification.

      2. EU 98/69/EC diesel minibus emission standards are shown in Table 9 of this Appendix.

    17. Applicants of compliance certification for diesel minibuses shall append the following documents and proceed pursuant to the regulations of the central competent authority:

      1. Application letter (including a seal impression card)

      2. Review form

      3. Compliance certification draft

      4. Chinese vehicle specification table

      5. Light Diesel and Alternative Clean Fuel Engine Compliance Certification Application Form (See Table 10 of this Appendix)

      6. Photocopy of diesel vehicle exhaust smoke test report

      7. Single photographs (including four sides, engine, driver's compartment, chassis)

      8. Label

      9. If complying with the regulations of Article 4, Paragraph 11, Subparagraph 1, Item 2 of this Appendix, the original manufacturer shall state that the air pollution emission values of the vehicle type are identical with those of the original foreign vehicle type, and comply fully with the laws and regulations of the ROC; this statement shall bear the signature or seal of the manufacturer's authorized statutory responsible person.

      10. The vehicle manufacturer's letter of authorization authorizing its domestic agent. The letter of authorization shall grant the domestic agent full power to represent that vehicle manufacturer, allowing it to apply for diesel minibus compliance certification. Both parties must comply fully with relevant laws and regulations.The domestic agent must also prove that it bears identical obligations with the vehicle manufacturer.When there is no letter of authorization from the vehicle manufacturer, an association jointly composed of importers may submit an application, and shall attach a guarantee vouching that it bears identical obligations with the vehicle manufacturer.

      11. New vehicle random testing guarantee

      12. Import and commodities tax payment (exemption) certificate issued by customs

      13. Emission black smoke quality control plans for diesel minibuses at least shall include least the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 200 diesel minibuses shall be subjected to random testing.

      14. Operating manual (shall include emission control system warranty, and clearly specify inspection items and parts requiring replacement during the warranty period)

      15. Diesel minibuses in compliance with relevant testing regulations and subsequently revised regulations of EU Directive 98/96/EC shall also be equipped with an OBD system and all documents required by the Directive shall be appended pursuant to the Directive and subsequent revisions.

    18. Other regulations

      1. The application and appended documents for compliance certification shall be in Chinese or English. Foreign automakers that have documents in a language other than Chinese or English shall provide a Chinese translation of these documents. These documents must bear the signature or seal of the authorized statutory responsible person. Recently updated information shall also be submitted.

      2. The vehicle manufacturer shall comply with all applicable regulations in order to demonstrate compliance with emission standards.

      3. An applicant shall preserve the most recent documents recording data and test results; said records shall be preserved for five years from the date of issuance of the compliance certification letter.

    In establishment of their limit values the terms of ISO 4259, Petroleums products –
    Determination and application of precision data in relation to methods of test,
    have been applied and in fixing a minimum value, a minimum difference of 2R above zero
    has been taken into account; in fixing a maximum and minimum value,
    the minimum difference is 4R ($ = reproducibility). Notwithstanding this measure,
    which is necessary for statistical reasons, the manufacturer of a fuel should nevertheless
    aim at a zero value where the stipulated maximum value is 2$ and at the mean value
    in the case of quotations of maximum and minimum limits.
    Should it be necessary to clarify the question as to whether a fuel meets the requirements
    of the specification, the terms of ISO 4259 should be applied.
  3. The range for cetane number is not in accordance with
    the requirement of a minimum range of 4R.
    However, in the case of dispute between fuel supplier and fuel user, the terms in
    ISO 4259 can be used to resolve such disputes provided replicate measurements, of sufficient
    number to achieve the necessary precision, are made in preference to single determinations.
  4. The month of publication will be completed in due course.
  5. The actual sulphur content of the fuel used for the test shall be reported.
    In addition, the sulphur content of the reference fuel used to approve a vehicle
    or engine against the limit values set out in row B of the Table
    in section 6.2.1. of Annex I to this Directive shall have a maximum sulphur content of 50 ppm.
    The Commission will as soon as possible, but no later than 31 December 1999,
    bring forward a modification to this Annex reflecting the market average
    for fuel sulphur content in respect of the fuel defined in Annex IV to Directive 98/70/EC.
  6. Even though oxidation stability is controlled, it is likely that shelf life will be limited.

Appendix 2: Documents to be attached to an application for compliance certification for heavy diesel vehicle engines, selection of a test engine, test fuel standards, acknowledgement of foreign compliance certification and testing reports, and other binding matters

  1. When applying for heavy diesel vehicle compliance certification, the applicant shall submit attached documents to the central competent authority to verify that the engine used by the vehicle model complies with emission standards; the central competent authority may issue a heavy diesel vehicle compliance certification letter (herein referred to as compliance certification) after determining that the engine used by that vehicle model complies with emission standards.

  2. Deterioration factors for the engine family must be submitted with an application for compliance certification; deterioration factors shall be determined as prescribed in Article 11 of these Regulations.

  3. Test Engine and Test Fuel Standards

    1. Test Engine

      A test engine must comply with information stated on the engine manufacturer's compliance certification application. Testing shall be performed in accordance with the test method specified in Article 18 of these Regulations, and the test engine shall comply with all necessary conditions prescribed in this Appendix.

      1. Test Engine Selection

        The applicant shall select a test engine on the basis of engine family classification, and test the engine's exhaust gas emission value. Test engines in each engine family shall be selected in accordance with the following conditions:

        1. Heavy diesel engine: Select the engine with the largest horsepower or single-stroke fuel injection volume (whichever has the highest pollution value) in the same engine family.
      2. Endurance Test Engine

        The applicant may select one representative engine in each engine family for endurance testing. The central competent authority must review and agree to the choice of endurance test engine and endurance test plan, and the applicant shall provide endurance testing results for each stage to the central competent authority in a timely manner in accordance with the plan.

    2. Test Fuel

      1. Pollution Test Diesel Standards

        1. Pollution test diesel standards

          1. When following US FTP Transient testing methods, engines meeting July 1, 1993 and July 1, 1999 emission standards shall be tested using fuel complying with US 1994 test fuel standards (Table 1 in this Appendix); engines meeting January 1, 2007 emission standards shall be tested using fuel complying with US 2004 test fuel design (Table 2 in this Appendix).

          2. When following testing regulations contained in European Union Directive 1999/96/EC, engines shall be tested using fuel complying with test fuel standards in that directive and subsequently revised test fuel standards (Table 3 in this Appendix).

        2. Pollution test alternative clean fuel standards

          Alternative clean fuel used in pollution testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. However, the manufacturer must guarantee that when accepting on-sale fuel in domestic use for random pollution testing of new vehicles, such on-sale fuel shall comply with the ROC's emission standard regulations in this Appendix. Standards governing foreign on-sale fuel may be employed when there is no on-sale fuel in the ROC.

      2. Pollution Test Diesel Standards

        1. Pollution test diesel standards

          Durability testing for diesel fuel shall use the standards for premium diesel fuel for sale on Taiwan's domestic market as the norm and select fuel for sale on domestic markets overseas. If several types of fuel are available on domestic markets overseas, the type nearest to the standards for premium diesel fuel for sale on Taiwan's domestic market shall be selected for testing.

        2. Endurance test alternative clean fuel standards

          Alternative clean fuel used for endurance testing shall comply with ROC standards, but may comply with foreign standards when there are no ROC standards. When there are neither domestic nor foreign standards, the fuel shall comply with standards governing domestic on-sale fuel. If there is no domestic on-sale fuel, the fuel may comply with standards governing foreign on-sale fuel.

  4. An applicant shall provide a Chinese user manual containing an emission control system warranty to the central competent authority for future reference. The manual shall contain a detailed account of maintenance regulations, and shall clearly specify items to be inspected and parts requiring replacement during the warranty period. The manual shall facilitate scheduled maintenance by the vehicle owner and ensure that the emission control systems of diesel and alternative clean fuel engines function normally within the effective use period.

  5. Labeling

    1. The engine manufacturer shall affix a durable, corrosion-resistant, rust-proof, clearly-legible English label not likely to fall off to the engine before it leaves the plant. The content of this label shall comply with the regulations of the country where the plant is located.The label shall be affixed to an easily-visible location in the engine compartment.

    2. An applicant who has obtained a compliance certification letter shall provide a Chinese label, which shall be affixed to the engine.This label shall be affixed in such a manner as to be destroyed or rendered illegible when removed from the engine.

    3. The Chinese text of the label shall include the following information:

      1. The label heading shall consist of vehicle exhaust control information.

      2. The full name of the company and trademark of the engine manufacturer

      3. Name of the engine family, engine displacement, emission control system, and identification of the model year

      4. The engine's optimal adjustment specifications and adjustment methods, which shall include at least the idle speed, injection timing, valve clearance, maximum horsepower, and maximum torque.

      5. The label shall clearly state "vehicle models containing an engine of this engine family comply with diesel vehicle emission standards implemented on July 1, 1999 (or January 1, 2004 or January 1, 2007)".

      6. A diagram showing the location of all air pollution control equipment specified in the label

  6. Warranty period

    1. The pollutant emissions of diesel vehicles shall comply with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards during the warranty period when in normal maintenance and use.

    2. The diesel motor vehicle emission control system warranty period shall be as prescribed in Article 5 of the Vehicular Air Pollutant Emission Standards and this Appendix.

    3. The warranty period of those complying with relevant testing regulations and subsequently revised regulations of EU Directive 1999/69/EC shall be determined pursuant to the aforesaid Directive and subsequent revisions.

  7. Diesel vehicles and alternative clean fuel engines may not be equipped with defeat devices. However, defeat devices that possess the following functions shall not be subject to this restriction:

    1. Necessary functions able to protect the diesel vehicle by preventing damage or accidents

    2. Functions no longer activated after the engine has started and the vehicle has warmed up

  8. Testing and inspection

    1. When an applicant applies for a compliance certification letter, the central competent authority may request that the applicant select at least one engine and bring the engine(s) to the location designated by the central competent authority for testing; the applicant shall bear responsibility for all necessary expenses.

    2. When an engine manufacturer applies for a compliance certification letter, central competent authority personnel may enter the applicant's testing laboratory and factory, review the applicant's relevant records, determine whether the engine to be tested and mass production engines meet the regulations of this Appendix, and thereby confirm whether the engines comply with design standards stated at the time of application.

    3. When an engine manufacturer actually implements procedures needed for the applied-for testing, the central competent authority may send personnel to oversee or inspect the preparation process. The central competent authority may also designate a professional testing organization to jointly perform oversight and inspection work in conjunction with the central competent authority.

  9. Testing Standards and Test Report

    1. Testing standards

      1. Heavy diesel vehicles with GVW greater than 3,500 kilograms shall be subjected to engine dynamometer testing in accordance with the FTP Transient testing method, or testing in accordance with the testing method specified in EU Directive 1999/96/EC and subsequently revised test standards.

      2. Vehicles with GVW greater than 2,500 kilograms and less than or equal to 3,500 kilograms may be tested in accordance with either the FTP-75 testing method or the FTP Transient testing method.

      3. Those adhering to EU directives for N1-class vehicles with a gross vehicle weight less than or equal to 3,500kg shall comply with the test methods and test report standards of either EU Directive 98/69/EC and subsequent revisions or EU Directive 1999/96/EC and subsequent revisions.

    2. Test report

      1. Applicants of heavy diesel vehicles with a gross vehicle weight greater than 3,500kg must provide an FTP transient test report based on FTP Transient testing methods, or a test report in compliance with the test methods of EU Directive 1999/96/EC and subsequent revisions.

      2. If the gross vehicle weight is greater than 2,500kg and less than 3,500kg, the applicant shall provide a test report based on either the FTP-75 test report regulations, or the FTP test report regulations.

      3. Those adhering to EU directives for N1-class vehicles with a gross vehicle weight less than or equal to 3,500 kg shall comply with the test methods and test report standards of either EU Directive 98/69/EC and subsequent revisions or EU Directive 1999/96/EC and subsequent revisions.

  10. The engine emission air pollutant quality control plan shall, at the least, include the random self-testing method and ratio, testing method, testing procedures, testing results, testing records, corrective measures, assignment of personnel, testing equipment, and laboratory layout. No fewer than one out of every 500 heavy diesel vehicles of each vehicle type shall be subjected to random testing.(If the manufacturer fails to submit a quality control plan before the deadline, the competent authority shall cancel the certification and revoke the manufacturer's heavy diesel vehicle compliance certification and compliance certification letter.)

  11. Engine family

    1. Engines for which applications have been made for diesel vehicle compliance certification shall be classed on the basis of similar emission characteristics. Each class shall be defined as a separate engine family, and each engine family shall require a separate compliance certification application.

      Engines belong to the same engine family when the following relevant items are all identical:

      1. Cylinder bore center-to-center distance

      2. Cylinder block configuration (air- or water-cooled, L-6, 90° Celsius, or V-8).

      3. Intake and exhaust valve (or orifice) locations

      4. Air supply method (turbocharger)

      5. Pollution control system

      6. Fuel supply system

      7. Engine intake air cooling method (such as aftercooler or intercooler)

    2. If the central competent authority deems that an engine may have different emission characteristics even though the foregoing items are all identical, the central competent authority may classify that engine in a different engine family.The following engine characteristics shall be considered when making this type of decision:

      1. Cylinder bore and stroke

      2. Ratio of cylinder surface area to volume when engine is at the dead point

      3. Intake manifold orifice size and configuration

      4. Exhaust manifold orifice size and configuration

      5. Intake and exhaust valve sizes

      6. Camshaft and injection timing characteristics

    3. Standard engine family naming method

      1. Reason for standardized naming of engine families

        Standardized names make it easier to identify the model year and manufacturer of an engine family, and provide basic information concerning that engine family.Standardized name can also facilitate the testing process, and lessen errors made keying information into databases.Standard engine family names consist of a string of alphanumeric characters, and each character has its own specific meaning.

      2. Standard engine family names

        Standard engine family names consist of 11 alphanumeric characters, and have the following structure and representative meaning:

      5. Continued use of the engine family naming method

        An extra code may be appended to the original applied for engine family name when continuing to use an engine family name.

        1. Example

          If continuing to use an original engine family name of 2********** during the 2003 model year, the new name shall be 2**********-A3.

          2**********-A3。The codes appended for different model years are as shown in Table 8 of this Appendix.

      6. Enterprises that do not adopt the Standard Engine Family Naming Method in Article 11, Paragraph 3, of this Appendix for heavy diesel minibuses or heavy diesel trucks shall produce an 11-digit identification code for the engine family. However, the first digit of the identification code (Model Year Code) and those adopting the Standard Engine Family Naming Method must still comply with Article 11, Paragraphs 3 and 4 of this Appendix.
  12. Application Method

    1. Application for heavy diesel vehicle compliance certification consists of two steps:

      1. Application for compliance certification letter

      2. Application for diesel vehicle compliance certification

    2. If one of the following conditions listed below applies to the applicant, the application process shall be concurrent with the Stage II application process in Article 12, Paragraph 1 of this Appendix:
      1. Manufacturers of diesel fuel engines that also manufacture vehicles
      2. A designated agent for a manufacturer of diesel fuel engines that is also a designated agent for an enterprise that imports vehicles (or manufactures vehicles domestically)
    3. Applicants that have already obtained a compliance certification letter issued by the central competent authority (or a letter of guarantee and a photocopy of the letter of consent and compliance certification letter from the original holder of the compliance certification) and whose black smoke emissions score for the car model's engine family (the score for which is based on the Diesel Motor Vehicles Exhaust Emissions Testing Methods and Procedures) is in compliance with Article 5 of the Vehicular Air Pollutant Emission Standards, shall apply for diesel fuel vehicle compliance certification with the central competent authority.
  13. Application for compliance certification letter

    1. Application qualifications

      1. In the case where the applicant previously obtained diesel fuel engine family compliance certification issued by the United States EPA after verifying US-Transient Cycle test results, this compliance certification is sufficient evidence that the US-Transient Cycle testing equipment and capabilities in the laboratory conform to the testing standards of the US Environmental Protection Agency.

      2. If the foreign engine manufacturer of an imported heavy diesel vehicle designates a domestic agent to apply on its behalf, the applicant shall submit proof of service and maintenance ability.The applicant applying for an imported vehicle may commission a central competent authority designated professional testing organization or laboratory complying with the regulations of Article 13, Paragraph 2, Subparagraph 2 of this Appendix to implement the quality control plan, and shall submit quality control testing statistical analysis data for the previous quarter to the central competent authority for future reference before the 20th day of the first month of each quarter.

      3. Those that are not in compliance with items (a) or (b) in the foregoing paragraph shall commission a professional testing organization authorized by the central competent authority or a globally recognized testing organization approved by the central competent authority. The test values used in the laboratory may only be those considered acceptable by the central competent authority.

    2. Applying for a compliance certification letter

      1. Application method for an engine family that has received compliance certification from a country designated by the central competent authority

        1. If an applicant has received new vehicle model compliance certification issued by the US EPA after the vehicle passed testing by the FTP Transient method, and the exhaust certification value complies with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards, the applicant may apply to the central competent authority for a compliance certification letter.

        2. If an applicant has received vehicle model compliance certification issued by an EU member state in accordance with EU Directive 1999/96/EC and subsequently revised test standards, and the exhaust certification value complies with the regulations of Article 5 of the Vehicular Air Pollutant Emission Standards, the applicant may apply to the central competent authority for a compliance certification letter.

      2. Application method for an engine family that has not yet received compliance certification from a country designated by the central competent authority

        If an applicant has received a test report from a laboratory meeting the following laboratory qualifications, the applicant may apply to the central competent authority for a compliance certification letter:

        1. The laboratory has received diesel vehicle new vehicle model compliance certification issued by the US EPA after performing US Transient Cycle driving form testing, and the evidence is sufficient to verify that the laboratory possesses US Transient Cycle driving form testing equipment and testing capabilities, and that the US EPA has accepted test values from the laboratory.

        2. The laboratory has received diesel vehicle new vehicle model compliance certification issued by an EU member state after performing testing in compliance with Directive 1999/96/EC and subsequently revised test standards, and the evidence is sufficient to verify that the laboratory possesses testing equipment and testing capabilities specified in Directive 1999/96/EC and subsequently revised test standards, and that an EU member state has accepted test values from the laboratory.

        3. If not complying with Subparagraph 2, Items (a) and (b) of this Appendix, the central competent authority shall accept the test values of that laboratory if a central competent authority designated professional testing organization or the central competent authority agrees that the laboratory is a professional testing organization possessing international credibility.

  14. Issuance of compliance certification letter

    1. The central competent authority may issue a compliance certification letter for the engine family after the information submitted by the applicant in accordance with Article 13, Paragraph 1, Subparagraphs 1 and 2 of this Appendix has been reviewed and approved.The compliance certification letter shall provide solely necessary documents for when the central competent authority issues diesel vehicle compliance certification.

    2. The central competent authority shall issue a compliance certification letter solely for one model year.

    3. The central competent authority shall notify the applicant in writing if the central competent authority deems that test data or information submitted when applying for a compliance certification letter does not comply with emission standards.

  15. Continued use of a compliance certification letter

    1. An applicant may re-submit a reviewed and approved compliance certification application for a domestic vehicle of a previous model year.

    2. A manufacturer holding a compliance certification letter shall submit design elements connected with pollution emissions for the diesel engine family to the central competent authority on an annual basis.

  16. Revision of a compliance certification letter

    If an applicant plans to amend certain engine family information and continue to use the original engine family, the applicant shall apply to the central competent authority for amendment of the compliance certification letter, and shall attach comparative data for the engine type before and after modification. The applicant shall verify that all items affecting emission pollution are identical, and that the engine possesses identical emission characteristics. The central competent authority may permit amendment of the compliance certification letter after approval of the application.

  17. Extension of a compliance certification letter

    An applicant planning to add a new engine type to the same engine family shall first apply to the central competent authority for extension of the compliance certification letter.The applicant shall submit data on the added engine type verifying that all items affecting emission pollution are identical, and that the new engine type possesses identical emission characteristics. The central competent authority may permit an extension of the compliance certification letter after approval of the application.

  18. Acknowledgement of EU Directive 1999/96/EC regulations

    1. From the date of promulgation of these Regulations, an applicant may apply for a compliance certification letter for ROC January 1, 2007 diesel and alternative clean fuel engine vehicle emission standards by presenting EU heavy diesel engine vehicle model compliance certification.

    2. Heavy diesel and alternative clean fuel engine emission standards in EU Directive 1999/96/EC are shown in Tables 9 and 10 of this Appendix.

    3. Those adhering to relevant testing regulations and subsequently revised regulations of EU Directive 1999/96/EC shall submit OBD certification documents pursuant to the aforesaid Directive and subsequent revisions.

  19. Completion of forms

    An applicant shall fill out the required information in accordance with the application format specified by the central competent authority (as shown in Table 11 of this Appendix) when applying for a compliance certification letter.

  20. Other regulations

    1. The application and appended documents for compliance certification shall be in Chinese or English. Foreign automakers that have documents in a language other than Chinese or English shall provide a Chinese translation of these documents. These documents must bear the signature or seal of the authorized statutory responsible person. Recently updated information shall also be submitted.

    2. The engine manufacturer shall comply with all applicable regulations in order to demonstrate compliance with emission standards.

    3. An applicant shall preserve the most recent documents recording data and test results; said records shall be preserved for five years from the date of issuance of the compliance certification letter.

    In establishment of their limit values the terms of ISO 4259, Petroleums products –
    Determination and application of precision data in relation to methods of test,
    have been applied and in fixing a minimum value, a minimum difference of 2R above zero
    has been taken into account; in fixing a maximum and minimum value,
    the minimum difference is 4R ($ = reproducibility). Notwithstanding this measure,
    which is necessary for statistical reasons, the manufacturer of a fuel should nevertheless
    aim at a zero value where the stipulated maximum value is 2$ and at the mean value
    in the case of quotations of maximum and minimum limits.
    Should it be necessary to clarify the question as to whether a fuel meets the requirements
    of the specification, the terms of ISO 4259 should be applied.
  3. The range for cetane number is not in accordance with
    the requirement of a minimum range of 4R.
    However, in the case of dispute between fuel supplier and fuel user, the terms in
    ISO 4259 can be used to resolve such disputes provided replicate measurements, of sufficient
    number to achieve the necessary precision, are made in preference to single determinations.
  4. The month of publication will be completed in due course.
  5. The actual sulphur content of the fuel used for the test shall be reported.
    In addition, the sulphur content of the reference fuel used to approve a vehicle
    or engine against the limit values set out in row B of the Table
    in section 6.2.1. of Annex I to this Directive shall have a maximum sulphur content of 50 ppm.
    The Commission will as soon as possible, but no later than 31 December 1999,
    bring forward a modification to this Annex reflecting the market average
    for fuel sulphur content in respect of the fuel defined in Annex IV to Directive 98/70/EC.
  6. Even though oxidation stability is controlled, it is likely that shelf life will be limited.
    Advice should be sought from the supplier as to storage conditions and life.

Appendix 3: Determination of Diesel Vehicle and Diesel Engine Deterioration Factors

  1. Each individual engine family shall have its own exhaust emission deterioration factor representing the durability performance of the vehicle or engine in actual use when the purchaser of the vehicle performs maintenance in accordance with the provided manual.Gaseous pollutant and particulate pollutant deterioration factors are multiplied by or added to individual pollution test values.

  2. Deterioration factors are defined according to the following methods:

    1. Adoption of actual vehicle or engine durability test
      1. Execution of durability test:
        1. The value of an exhaust emission deterioration factor shall be determined in accordance with the results of an endurance test.The applicant shall provide the cumulative mileage drive cycle and plan for conducting durability tests on diesel vehicles (or engines); the durability test may be conducted only after the central competent authority has reviewed and approved the plan.
        2. The durability test plan shall include at minimum the following items:
          1. Testing organization (including information on the testing abilities of the organization)
          2. Vehicle (or engine) to be tested
          3. Testing procedures
          4. Testing schedule:
          5. Testing equipment
          6. Maintenance and service items
          7. Test fuel
        3. If the value of an exhaust emission deterioration factor determined by a vehicle or engine manufacturer is less than one (when used for multiplication), that value shall be taken to be one.
        4. Once the durability test plan has been executed, the central competent authority must review and approve the execution before the deterioration factor of the durability test may be used.
      2. The adoption of US or EU compliance certification: Applicants of an engine family or vehicle model with a completely acquired or imported basic engine and emission control system that has already obtained US or EU compliance certification shall submit relevant information on the US or EU compliance application and certification, and shall use the durability deterioration factor stated on the compliance certification.
      3. The regulations for using the designated deterioration factors are as follows:
        1. If an engine family or car model either manufactured domestically or acquired overseas has not yet obtained US or EU compliance certification, the applicant shall append an explanation of the original engine or vehicle manufacturer's adoption of the designated deterioration factors pursuant to this Appendix.
        2. If the engine family or car model has already obtained US or EU compliance certification, the applicant shall submit the US or EU compliance certification certificate and use the deterioration factor stated on the compliance certification.
        3. Imported foreign new vehicles and in-use vehicles from overseas that are less than one year old (calculated from the date of production to the date of import) with individual compliance certification applications shall use the designated deterioration factors.In-use vehicles from overseas that are more than one year old (calculated from the date of production to the date of import) do not need to use deterioration factors.
        4. The designated deterioration factor values are as follows:
          1. Light trucks and minibuses: carbon monoxide; 12, hydrocarbons; 10, nitrogen oxides; 10, particulate pollutants; 15, all deterioration factors are multiplicative
          2. Heavy passenger vehicles and trucks:
            1. No post-treatment system (see Table 1)
            2. With post-treatment system (see Table 2)
          3. Those in compliance with relevant testing regulations and subsequently revised regulations of EU Directive 98/69/EC or EU Directive 1999/96/EC shall use the designated values for deterioration factor pursuant to the EU Directive.
        5. If the central competent authority determines for some reason that the regulations for designated deterioration factors cannot be used to obtain deterioration factors for vehicles or engines in a specific engine family, the aforesaid regulations may not be applied to that vehicle type or engine family.
  3. In an endurance test for vehicles or engines, the test values obtained for the test vehicle or engine after exceeding the cumulative warranty period or mileage shall be quantified as the deterioration factors.The regulations in Article 5 of the Vehicular Air Pollutant Emission Standard shall prescribe the range of gross vehicle weights and endurance test time or mileage.

Appendix 4: Testing ratio for new vehicle random testing, determination of test results, and other matters requiring attention for diesel vehicles and alternative clean fuel engines

  1. General regulations

    1. With regard to the diesel vehicle type or engine recorded on the compliance certification, the central competent authority may itself implement or commission a professional testing organization to implement new vehicle random testing of a vehicle type or engine when the manufacture or import of the vehicle or engine has reached a quantity or period of time prescribed by the central competent authority. If it deems that a vehicle or engine has failed random testing, the central competent authority shall revoke the compliance certification or compliance certification letter of that vehicle or engine, and shall notify the highway supervisory authority to cancel issuance of the license if the license has been authorized but not yet issued.During new vehicle random testing, the central competent authority may inspect the emission control system of a vehicle to determine whether it complies with specifications at the time of diesel vehicle compliance certification application. The central competent authority shall revoke the compliance certification of the vehicle if the emission control system does not comply with specifications.

  2. Random testing regulations

    1. A random sample of vehicles or engines shall be subjected to random testing.

    2. The central competent authority shall select and designate random testing vehicles or engines.The same engine family or vehicle in the same model year may be subjected to random testing more than one times.Applicants shall bear full responsibility for testing fees and random testing vehicle transport costs.

    3. Any diesel vehicle that has obtained compliance certification may be provided to the central competent authority for selection and testing.The following method is used to select a random testing vehicle:

      1. A vehicle stored at ROC customs or port, or vehicle selected on the basis of customs import certificate.

      2. A vehicle manufacturer's storage area for vehicles that have completed compliance certification.

    4. Formal selection of a vehicle or engine, the vehicle or engine shall be sent to the designated location under the supervision of central competent authority designated personnel.

    5. The central competent authority shall provide a detailed explanation of the random sampling method, testing, and pre-testing actions when giving notification of new vehicle random testing.

    6. When a quality control plan is attached to the compliance certification application, the new vehicle random testing quantity and plan shall be implemented in accordance with Article 2, Paragraph 6, Subparagraphs 1 to 4 of this Appendix or accordance with Article 2, Paragraph 6, Subparagraph 6 of this Appendix.

      1. Random testing sampling plan regulations: The random testing sampling plan shall be determined on the basis of projected annual sales volume (see Table 1 of this Appendix).

      2. When the final deterioration test value of a certain pollutant produced by a test vehicle or engine exceeds the emission standard, that vehicle or engine shall be deemed to have failed.

      3. When all pollutants comply with the random testing sampling plan and determination standards (see Table 2 of this Appendix), the test vehicle or engine shall be deemed to have passed random testing.If a certain pollutant does not comply with the random testing sampling plan and determination standards, the vehicle or engine shall be deemed to have failed random testing.

      4. Compliance with the random testing sampling plan and determination standard shall be determined on the basis of the number of tests determined passing and the number of tests determined failing under that plan.If the cumulative number of failing tests for a certain pollutant is less than or equal to the number of passing tests out of the cumulative number of tests, that pollutant complies with the random testing sampling plan and determination standard.If the cumulative number of failing tests for a certain pollutant is greater than or equal to the number of passing tests out of the cumulative number of tests, that pollutant does not comply with the random testing sampling plan.

      5. When a certain pollutant has been determined to comply with the random testing sampling plan and determination standards, the cumulative number of failing tests for that pollutant shall not further be included among audit items.

      6. After an application for a compliance certification letter or compliance certification has been made, and the vehicle or engine has passed new vehicle random testing, one out of every 500 vehicles of the same engine family or vehicle type shall be subjected to random testing (one vehicle shall still be subjected to random testing if there are less than 500 vehicles or engines in a year).If one (or more than one) vehicle or engine subjected to random testing fails to comply with emission standards, the vehicle or engine shall be deemed to have failed random testing.

    7. When a quality control plan is not attached to the compliance certification application, after the vehicle or engine has passed new vehicle random testing, one out of every 200 vehicles of the same engine family or vehicle type shall be subjected to random testing (one vehicle shall still be subjected to random testing if there are less than 200 vehicles in one year).If one (or more than one) vehicle or engine subjected to random testing fails to comply with emission standards, the vehicle or engine shall be deemed to have failed random testing.

  3. Vehicle or engine sampling and preparation

    1. A selected random testing vehicle or engine shall be a vehicle or engine produced by the vehicle or engine manufacturer via large-scale production processes (such as quality control and assembly processes).

    2. A random testing vehicle or engine shall have received normal maintenance and not been subject to any misuse.

    3. The mileage of a random testing vehicle or engine may not exceed 6,400 kilometers (or 125 engine operating hours).Those in compliance with relevant regulations and subsequently revised regulations of EU Directive 98/69/EC or EU Directive 1999.96/EC shall proceed pursuant to these Directives and subsequent revisions.

    4. If a vehicle or engine manufacturer wishes to implement mileage accumulation, adjustment, or modification testing procedures or maintenance work, the manufacturer may do so under the supervision of central competent authority designated personnel after obtaining the consent of the central competent authority.

    5. When a vehicle or engine manufacturer is authorized by the central competent authority to perform inspection or adjustment, the manufacturer may only use testing and diagnostic equipment with functions identical to those of equipment used by distributors.

    6. In order to facilitate the implementation of testing work, the vehicle or engine manufacturer shall supply all special hardware, equipment, and essential personnel needed to perform effective preparatory tasks within four weeks of the day after receiving notification from the central competent authority.The vehicle or engine manufacturer may not use the excuse of being unable to provide the said special hardware, equipment, or personnel to render the test invalid.

    7. The vehicle or engine manufacturer shall implement test vehicle or engine preparation tasks, mileage accumulation, transport, inspection, and maintenance to ensure that the random testing process can be performed rapidly.

    8. A new vehicle random testing vehicle or engine must comply with the following regulations:

      1. A new vehicle random testing vehicle or engine shall accumulate the minimum mileage before testing in accordance with Article 3, Subparagraph 4 of this Appendix.If a random testing vehicle or engine cannot complete mileage accumulation, or if a vehicle or engine function cannot complete emission testing due to loss of function, the central competent authority may authorize the manufacturer to repair or adjust the vehicle or engine so as to restore it to a condition suitable for testing or a reasonable operating condition, or the vehicle or engine shall be eliminated from the number of vehicles or engines to be tested.

      2. If a vehicle or engine for testing is damaged or improperly adjusted due to inappropriate transport or mileage accumulation process, the manufacturer may take relevant corrective measures after obtaining the consent of the central competent authority.

      3. The vehicle or engine manufacturer may not perform adjustment, repair, or preparation, implement any maintenance or modification, or conduct any emission testing of the random testing vehicle or engine without first obtaining the consent of the central competent authority.However, the said preparation procedures shall not be subject to this restriction when they consist of the vehicle or engine manufacturer's production line inspection and preparation prior to delivery of the vehicle, and written records are kept.

      4. If the vehicle or engine manufacturer provides sufficient distributor survey data or other documentary proof to verify that the foregoing preparation procedures are indeed preparation procedures performed prior to delivery of the vehicle by the distributor, the central competent authority may permit the vehicle or engine manufacturer to implement identical preparation procedures.(The central competent authority shall not accept any unsupported claims by the vehicle or engine manufacturer that the distributor is uniformly requested to implement the said preparation procedures before delivery of the vehicle.)

      5. A vehicle or engine manufacturer who elects to perform mileage accumulation in accordance with the regulations of Article 3, Paragraph 8, Subparagraph 1 of this Appendix may implement the following specific maintenance items:

        1. Replacement of fuel injection nozzle

        2. Adjustment of fuel injection pump

        3. Replacement or charging of battery

        4. Safety inspection of wiring

      6. If the vehicle or engine manufacturer elects to subject a vehicle or engine with mileage accumulation less than that prescribed in Article 3, Paragraph 3 of this Appendix to random testing, the manufacturer may also implement the following additional specific maintenance items beyond the forgoing specific maintenance items:

        1. Replacement of particulate filter

        2. Replacement of lubricating oil or lubricating oil filter

      7. The manufacturer shall summarize the reasons for the necessity of any requested additional maintenance items and submit relevant information to the central competent authority before implementing such maintenance items.

  4. Testing procedures

    1. All testing shall comply with the regulations of Article 9 of Appendix 1, and Article 2, Paragraph 6, Article 3, Paragraph 8, and Article 4, Paragraph 8 of Appendix 2 of these Regulations.

    2. In accordance with Article 3, Paragraph 8 of this Appendix, the central competent authority may adjust or be forced to adjust due to necessity other "adjustable parts" to any point within their tolerance range.

    3. The central competent authority may specify a setting value exceeding the design scope during the implementation of new vehicle random testing emission testing if the central competent authority or central competent authority designated professional testing organization determine that a user may easily approach that setting value.

  5. Determination of test results

    In order to derive the final deteriorated test results, the deterioration factors of each test vehicle or engine shall be calculated in accordance with emission standards and these Regulations.Determination of whether a vehicle or engine passes random testing shall be performed in accordance with the regulations of Article 2, Paragraph 6 or Article 2, Paragraph 7 of this Appendix.

    1. The following measures shall be adopted when a vehicle or engine fails initial random testing:

      1. Vehicle or engine manufacturers (or domestic agents or importers) shall request a retest and bear responsibility for retest fees or may directly request determination of preliminary test to be non-compliant.Retesting is regulated as follows:

        1. Requests for repeat testing may only be made prior to removal of the test vehicle from the testing facility.

        2. No repairs, modifications or tests may be performed prior to the repeat test period.

        3. Results of the repeat test shall be considered the final result of the initial test, and all vehicles found to be in compliance with emissions standards shall be considered in compliance.

      2. A vehicle or engine manufacturer (or domestic agent or importer) has the following two options when a vehicle or engine fails initial testing:

        1. The manufacturer may accept the test results and affirm to the central competent authority its full commitment to modify all vehicles or engines in that engine family; this commitment shall encompass all vehicles or engines that have been sold to consumers or are as yet unsold, and the manufacturer shall fully explain all measures to be adopted.
        2. The vehicle or engine manufacturer burden may request a retest at its own expense.
      3. The vehicle or engine manufacturer that accepts the non-compliant initial test results shall, within four weeks of receiving notice from the central competent authority, submit an explanation of the measures to be taken to the central competent authority pursuant to Article 5, Paragraphs 5 and 6, of this Appendix.

      4. If a vehicle or engine manufacturer elects to request repeat testing, the manufacturer shall notify the central competent authority within two weeks of receiving notification from the central competent authority; the letter shall state that the vehicle or engine manufacturer shall bear responsibility for testing expenses. The letter shall bear the signature or seal of the authorized statutory responsible person of the vehicle or engine manufacturer.

    2. When a retest is performed in accordance with the regulations of Article 5, Paragraph 1, Subparagraph 1, Item 2 of this Appendix, new vehicle random testing shall be implemented on the basis of quantitative ratio in order to assess the emission characteristics of the engine family, and the retest shall be implemented in accordance with Article 5, Paragraph 1, Subparagraphs 1 through 3 of this Appendix.When new vehicle random testing is implemented in accordance with the compulsory quality audit system, retests shall be implemented in accordance with the regulations of Article 5 Paragraph 2, Subparagraph 4 of this Appendix.

      1. When new vehicle random testing is implemented on the basis of quantitative ratio, the retest sample quantity shall be at least two times the quantity prescribed in Article 2, Paragraph 6, Subparagraph 6 or Article 2, Paragraph 7 of this Appendix.

      2. If the retest shows the vehicle is non-compliant, the vehicle or engine manufacturer (or domestic agent or importer) shall request a retest prior to removal of the test vehicle from the testing facility and bear responsibility for retest fees.The results of the additional repeat test shall be considered final, and no repairs, modifications or tests may be conducted prior to the additional repeat test.

      3. When new vehicle random testing is implemented on the basis of quantitative ratio, the central competent authority shall deem the vehicle or engine to have passed new vehicle random testing when the arithmetic mean values of all air pollutants from all test vehicles or engines comprising the test sample in the initial test and retest are less than the emission standards, and no vehicle or engine has an emission value exceeding the emission standard by more than 50%.When the arithmetic mean values are greater than the emission standards or a single pollutant emission value exceed emission standards by more than 50%, the new vehicle random test shall be deemed non-compliant.

      4. When new vehicle random testing is implemented in accordance with the compulsory quality audit system, retest sampling and the retest plan shall be implemented in accordance with Article 2, Paragraph 6, Subparagraph 1 or Article 2, Paragraph 6, Subparagraph 5 of this Appendix.The central competent authority shall deem the vehicle or engine to have failed random testing if it does not pass the retest.

    3. When the central competent authority deems a vehicle or engine to have "failed" in accordance with regulations of Article 5, Paragraph 1 of this Appendix, the central competent authority shall revoke the exhaust compliance certification letter of that engine family and the compliance certification of any diesel vehicle using that engine family.The competent authority shall revoke the diesel vehicle compliance certification of the vehicle model if the vehicle fails only the black smoke test.The vehicle or engine manufacturer must recall all unsold, sold and in-use vehicles for correction and must submit a detailed explanation of the measures it will adopt.This explanation shall be inclusive of the regulations in Article 5, Subparagraphs 5 and 6 of this Appendix.

    4. When the central competent authority notifies a vehicle or engine manufacturer or its domestic agent (or importer) of the results of new vehicle random testing, the notification letter will explain any formal actions that the vehicle or engine manufacturer must take.

    5. When new vehicle random testing is implemented on the basis of quantitative ratio, and then the vehicle or engine manufacturer fails new vehicle random testing, the vehicle or engine manufacturer shall, within four weeks from the day following receipt of notice from the central competent authority, submit an improvement plan to the central competent authority.The improvement plan shall include the following items:

      1. An engineering assessment of the reasons each vehicle or engine exceeding applicable emission standards failed to meet said standards.

      2. An engineering assessment of the reason for failure

      3. The views of the vehicle or engine manufacturer concerning the nature of this problem

      4. A detailed explanation of corrective measures to be taken
      5. Plan implement timetable
    6. The vehicle or engine manufacturer shall state a pledge to perform the described corrective measures in the letter submitted to the central competent authority,and the letter must bear the signature or seal of the authorized statutory responsible person of the vehicle or engine manufacturer.

    7. The central competent authority shall simultaneously notify the Ministry of Transportation and Communications when notifying the vehicle or engine manufacturer or its domestic agent of revocation of the manufacturer's diesel vehicle compliance certification.

    8. The manufacturer of unsold vehicles whose diesel vehicle compliance certification have been revoked by the central competent authority shall, in accordance with these Regulations, re-apply for compliance certification for any unsold vehicles after implementing an approved improvement plan.
