These Regulations are determined pursuant to Article 11, Paragraph 1 of the Environmental Agents Control Act (herein referred to as this Act).
Environmental agent professional technicians shall include the three categories of environmental agent manufacturer professional technicians, environmental agent vendor professional technicians, and pest control operator professional technicians. The central competent authority shall determine the training classes to be taken by such personnel.
The central competent authority or its commissioned professional organization shall undertake the environmental agent professional technician training in the foregoing paragraph in accordance with personnel classification.
Those persons participating in environmental agent manufacturer professional technician training shall possess one of the following qualifications:
Received an environmental engineering, chemical engineering, industrial engineering, industrial safety, industrial/mining health, agronomy, horticultural technician, veterinarian, or pharmacist certificate from the Republic of China.
Be a graduate of a department of pharmacology, plant pests and disease, entomology, plant pathology, chemical engineering, chemistry, agricultural chemistry, environmental engineering, environmental science, public health, applied chemistry, food science, soil science, veterinary medicine, or industrial health and safety at a public or registered private college or higher or an overseas school at the college-level or higher that is recognized by the Ministry of Education.
Be a graduate of a department of science, engineering, agriculture, or medicine at a public or registered private college or higher or an overseas school at the college-level or higher that is recognized by the Ministry of Education, or possess an equivalent educational record, and possess at least one year of practical working experience in pharmaceutical manufacturing with verifying documents.
Be a graduate of a public or registered private high school of industry, agriculture, medicine, or nursing, or an occupational industry, agriculture, medicine, or nursing program attached to a high school, or possess an equivalent educational record, and possess at least two years of practical working experience in pharmaceutical manufacturing with verifying documents.
Possess at least three years of practical working experience in pharmaceutical manufacturing with verifying documents.
Those persons participating in environmental agent vendor professional technician training shall possess one of the following qualifications:
Be a graduate of a department of science, engineering, agriculture, or medicine at a public or registered private college or higher or an overseas school at the college-level or higher that is recognized by the Ministry of Education, of a public or registered private high school of industry, agriculture, medicine, or nursing, of another vocational high school, of a occupational industry, agriculture, medicine, or nursing program attached to a high school or higher, or possess an equivalent educational record.
Be a graduate of a public or registered private elementary school or higher, or possess an equivalent educational record, and possess at least one year of practical work experience in pharmaceutical management with verifying documents.
Possess at least three years of practical work experience in pharmaceutical management with verifying documents.
Those persons participating in pest control operator professional technician training shall possess one of the following qualifications:
Be a graduate of a department of science, engineering, agriculture, or medicine at a public or registered private college or higher or an overseas school at the college-level or higher that is recognized by the Ministry of Education, or possess an equivalent educational record.
Be a graduate of a public or registered private high school of industry, agriculture, medicine, or nursing, of another vocational high school, of a occupational industry, agriculture, medicine, or nursing program attached to a high school or higher, or possess an equivalent educational record, and possess at least one year of practical work experience in pest control, cleaning, or disinfection with verifying documents.
Be a graduate of a public or registered private high school or higher, or possess an equivalent educational record, and possess at least two years of practical work experience in pest control, cleaning, or disinfection with verifying documents.
Possess at least three years of practical work experience in pest control, cleaning, or disinfection with verifying documents.
A person participating in environmental agent professional technician training who is absent from class at least one-fourth of the total training time must withdraw from said training, and that person’s training expenses shall not be refunded.
In environmental agent professional technician training, examination or assessment grades for all subjects shall be expressed on a scale with 100 points as a perfect grade and 60 points as a passing grade. A grade of 60 points in any subject shall be considered a passing grade. However, a grade of 70 points is considered passing in practicums for pest control operator professional technicians.
In the foregoing paragraph, persons who fail to obtain a passing grade in any subject may apply for re-examination or re-assessment within one year after the date of completion of training. Such applications are limited to two re-examinations or re-assessments, however.
In the foregoing paragraph, those persons who still fail to achieve the passing standard in Paragraph 1 after the second re-examination or re-assessment may, when the failed subjects do not exceed one-fourth of all training subjects, may apply for re-training and re-examination or re-assessment within three months after the date of the conclusion of the second re-examination or re-assessment in the failed subject(s). Only one such application may be made, however.
Those persons participating in environmental agent professional technician training may submit within 30 days after the second day after delivery of their grade notice a written application for review to the central competent authority. Only one review may be performed, however.
The central competent authority shall preserve environmental agent professional technician training examination test papers and assessment records for three months from the date of conclusion of examination or assessment.
Those persons who successfully meet training requirements shall submit an application form and documents verifying the education and work experience specified in articles 3 through 5 to the central competent authority to request issuance of a qualification certificate.
In the foregoing paragraph, Chinese translations shall be attached when foreign documents verifying education and work experience are submitted; in such a case, the original verification documents and Chinese translations shall be attested by an official unit overseas or organization authorized by the Ministry of Foreign Affairs.
The training passing qualifications in Paragraph 1 shall be valid for one year after the date of the final examination or assessment.
When necessary, the central competent authority may hold in-service training for environmental agent professional technicians; environmental agent professional technicians and the environmental agent enterprises that employ them may not refuse this training.
An environmental agent manufacturer shall establish at least one position for dedicated environmental agent manufacturer professional technicians; an environmental agent vendor shall establish at least one position for dedicated environmental agent vendor professional technicians; and a pest control operator shall establish at least one position for dedicated pest control operator professional technicians.
When an environmental agent manufacturer concurrently acts as an environmental agent vendor in the same premises, its environmental agent manufacturer professional technicians may concurrently serve as an environmental agent vendor professional technicians.
An environmental agent vendor may employ a person who has received an environmental agent manufacturer professional technician qualification certificate to serve as an environmental agent vendor professional technicians.
Environmental agent manufacturers, environmental agent vendors, and pest control operators shall submit a professional technician qualification certificates, position establishment application forms, and letters of consent agreeing to query of labor and health insurance information to the special municipality, county or city competent authority for approval.
When the status of a pest control operator professional technician changes, the enterprise shall re-apply to the original authority for approval in accordance with the regulations in the foregoing paragraph within 15 days after the change takes place.
If an environmental agent manufacturer or environmental agent vendor professional technician position is vacant for some reason, or if the technician cannot perform his or her duties, the enterprise shall promptly designate an appropriate employee to act in the technician’s place, and shall report the situation to the competent authority within 15 days. The substitution period may not exceed three months, but may be extended to six months after obtaining the competent authority’s approval. The enterprise shall re-apply for approval in accordance with the regulations in Paragraph 1 before the substitution period ends.
The resignation of an environmental agent professional technician shall be reported to the competent authority within 15 days.
The various types of environmental agent professional technicians shall implement the following duties:
Environmental agent manufacturer professional technicians:
Plant area and manufacturing area sanitation and management.
Manufacturing process supervision.
On-site implementation of oversight tasks during the manufacture of environmental agents.
Supervision of the management of technical grade environmental agents, semi-finished products, and finished products.
Oversight of records produced pursuant to Article 24 of the Environmental Agents Control Act, and signing or application of seal after confirming records are free of error.
Assisting with emergency control measures and notification tasks when environmental pollution threatening the ecology or human health occurs; assisting with clean-up and restoration management tasks after an accident occurs.
Relevant environmental agent manufacturing management matters.
Environmental agent vendor professional technicians:
Management of health, safety, and protective measures in environmental agent sales premises.
Provision of advisory channels concerning environmental agent use precautions.
Oversight of records produced pursuant to Article 24 of the Environmental Agents Control Act, and signing or application of seal after confirming records are free of error.
Assisting with emergency control measures and notification tasks when environmental pollution threatening the ecology or human health occurs; assisting with clean-up and restoration management tasks after an accident occurs.
Relevant environmental agent sales management matters.
Pest control operator professional technicians:
Supervision of maintenance and management of agent application equipment and safety equipment.
Production of pest control implementation plans.
Management of environmental agents dilution and use.
On-site oversight tasks when pest control work is performed.
Oversight of records produced pursuant to Article 24 of the Environmental Agents Control Act, and signing or application of seal after confirming records are free of error.
Assisting with emergency control measures and notification tasks when environmental pollution threatening the ecology or human health occurs; assisting with clean-up and restoration management tasks after an accident occurs.
Relevant pest control management matters.
The professional technicians employed by environmental agent manufacturers, environmental agent vendors, and pest control operators shall be full-time personnel.
The full-time personnel in the foregoing paragraph shall refer to personnel bearing on-site responsibility for the various requisite duties of professional technicians when environmental agents are manufactured, environmental agents are sold, or pest control work is performed.
The qualification certificate of an environmental agent professional technician shall be revoked when any one of the following situations applies:
Implementation of illegal or improper work has caused pollution of the environment or endangered human health, and the circumstances are severe.
Simultaneously employed at different places as a professional technician.
Has allowed another person to be established as a professional technician falsely using his or her name.
Other situations violating these Regulations or relevant environmental protection laws and regulations, and the circumstances are severe.
Persons whose qualification certificates are revoked as stated in the foregoing paragraph may not seek to obtain another qualification certificate within a five-year period. Those who seek another qualification certificate must re-take training.
Persons who had passed training and received pest control management personnel qualification certificates prior to the promulgation and enforcement of these Regulations shall submit their qualification certificates and documents verifying education and work experience as prescribed in Article 5 before applying to the central competent authority for issuance of a pest control operator professional technician qualification certificate.
Persons who had passed training and received pest control technician qualification certificates prior to the promulgation and enforcement of these Regulations shall take necessary additional classes; after passing the required classes, such persons shall submit their qualification certificates and documents verifying education and work experience as prescribed in Article 5 before applying to the central competent authority for issuance of a pest control operator professional technician qualification certificate.
These Regulations shall take effect on the date of promulgation.
