Handling Management Including Restricted Uses for Toxic Chemical Substances such as Polychlorinated Biphenyls as Announced in the List of 161 Regulatory Control Numbers

Summary:

Announcement of revised Handling Management Requirements Including Restricted Uses for Polychlorinated Biphenyls and other Toxic Chemical Substances of the 161 Controlled Substances List.

Basis:

Articles 5, 9, 10, 11, 16 and 27 of the Toxic Chemical Substances Control Act.

Announced Items:
  1. The toxic chemical substances referred to in this announcement include materials containing more than the controlled concentration standards of 252 controlled chemical substances including polychlorinated biphenyls under 161 regulatory control numbers (regulatory control numbers 001 to 019, 022 to 126, and 128 to 164) listed in Attached Table 1; minimum control limits and toxicity classification are shown in Attached Table 1. However, the following materials shall not be subject to this restriction:

    1. Controlled chromium compounds contained in additive adhesive, forming, gel, emulsion, and suspension products.

    2. Lindane used in the manufacture of drugs.

    3. Mercury contained in fluorescent lights, appliance switches, thermometers, pressure gauges, liquid hydrometer, and other manufactured products.

    4. Cadmium contained in television image tubes, cadmium vapor lamp electrodes, cadmium battery electrode plates, rectifiers, semiconductors, and other manufactured products.

    5. Manufactured products containing toxic chemical substances used as plasticizers when already solidified and will not cause hazard in normal use.

    6. Pesticides referred to in the Pesticide Management Act, animal feed and animal feed additives referred to in the Animal Feed Management Act, animal drugs referred to in the Animal Drug Management Act, drugs referred to in the Pharmaceutical Affairs Act, controlled drugs referred to in the Controlled Drug Management Statute, cosmetics referred to in the Cosmetic Sanitation Management Statute, foods referred to in the Food Sanitation Management Act, tobacco products referred to in the Tobacco Control Act, radioactive matter referred to in the Atomic Energy Act, chemical substances listed as controlled by the Montreal Protocol, environmental agents referred to in the Environmental Chemical and Biological Agents Control Act, and matter registered for future reference or approved for disposal.

  2. Attached Table 2 contains prohibitions on the use of 58 types of controlled chemical substances (regulatory control numbers 001 to 019, 022 to 037-04, 047, 052, 054, 055-03, 056-02, 057 to 059, 063 to 065, 103, 148, and 158) including polychlorinated biphenyls when exceeding concentration standards listed in Attached Table 1.

  3. Except when prohibited, use of Class 1, Class 2, and Class 3 toxic chemical substances listed in Attached Table 1 shall be restricted to uses listed in Attached Table 3.

  4. The user shall immediately dispose of capacitors and transformers containing polychlorinated biphenyls when no longer in use. Operational personnel do not need to regularly report toxic chemical substance use records, and do not need to mark handling sites and facilities in accordance with the Guidelines for Marking of Packaging and Handling Sites and Facilities of Toxic Chemical Substances and Establishment of Safety Data Sheets.

  5. Asbestos storage areas shall be sealed sites. Asbestos shall be stored in containers sufficient to prevent airborne dispersal or loss, the relevant operating standards for which are as follows:

    1. Asbestos bag collection tasks shall be performed in facilities that prevent the airborne dispersal of asbestos.

    2. Sturdy containers shall be employed to pack asbestos bags, and the containers shall be lined with paper inner lining bags or other appropriate lining.

    3. Except when necessary to open asbestos bag packing containers to collect and fill asbestos, such containers shall be maintained in a sealed condition at all times.

    4. Asbestos bag packing containers shall be marked with graphic symbols indicating toxic asbestos, the name of the contents, hazardous ingredients, hazard warning information, hazard prevention measures, and name, address, and telephone number of the supplying (collecting) company during collection and transport.

    5. A toxic chemical substance shipping manifest shall be completed before transporting asbestos bag packing containers, and shall be reported to the environmental protection competent authorities of the starting point and destination. The owner, shipper, and consignee shall adequately preserve such shipping manifests for one year for future reference.

  6. During the manufacture, use, storage, or conveyance of toxic chemical substances containing chlorine, handy emergency leak stoppage tools shall be readily available whenever handling a quantity of more than 50 kilograms at any one site at any one time; water mist spray facilities shall be readily available whenever handling a quantity of more than 100 kilograms at any one site at any one time; and a safety isolation protection system (secondary isolation system) shall be installed whenever handling a quantity of more than 2 tons at any one site at any one time.

  7. During the manufacture, use, storage, or conveyance of toxic chemical substances containing phosgene, a safety isolation protection system (secondary isolation system) and at least two reaction detoxification or absorption facilities shall be installed whenever handling a quantity of more than 5 kilograms at any one site at any one time.

  8. Ethylene oxide or formaldehyde may be stored within the handling site in accordance with relevant sanitation and labor safety laws and regulations when ethylene oxide is used for disinfection of medical equipment in a hospital or clinic or formaldehyde is used as for fixed antiseptic or disinfectant purposes in a hospital or clinic. If a toxic chemical substance containing over 1% w/w 4,4’-Methylenebis(2-chloroaniline) (regulatory control number 067) is used to waterproof and pave a handling site used as a working area, when transporting such toxic chemical substances to the work site, the fifth leaf of the toxic chemical substance shipping manifest shall be submitted or faxed to the local competent authority, or the shipping manifest shall be reported online, before work may begin at said site. A use and storage registration document or permit shall not be required, nor shall the assignment of professional technical management personnel be required. Such a toxic chemical substance used at a work site shall have a uniform registration number of 067-00-00001.

  9. Polychlorinated biphenyls, phosgene, methyl isocyanate, chlorine, 1,3-butadiene, hydrogen cyanide, 1,2-dichloroethane, vinyl bromide, fluorine, or phosphine shall not be stored at an office or place of business.

  10. Because there are no appropriate detectors or alarms, the installation of detectors or alarms in places where Dinoseb, aniline, chromium trioxide, phthalic anhydride, dimethyl sulfate, or tributyltin oxide are manufactured, used, or stored may be waived.

  11. The handling of toxic chemical substances listed in Attached Table 1 shall be conducted in accordance with the Toxic Chemical Substances Control Act, regulations concerning the handling of toxic chemical substances in EPA Announcement EPA Tu-Tzu No. 0083778 of December 24, and other relevant laws and regulations. Table 4 contains the dates on which the EPA announced the designation of various substances as toxic chemical substances.

    1. Improvement Regulations of the Toxic Chemical Substance Handling Regulations shall not be applicable to the handling of substances with regulatory control numbers 001 to 019 and 022 to 066.

    2. A user handling toxic chemical substances with regulatory control numbers 067 to 077-01, 078 to 126, and 128 to 146 prior to December 24, 1999, or toxic chemical substances with regulatory control numbers 077-02 and147 to 164 prior to March 15, 2000 shall complete improvement before the improvement deadline in accordance with Toxic Chemical Substance Handling Regulations Ⅵ. and the dates of designation as toxic chemical substances listed in Attached Table 4.

    3. A handler wishing to use Dinoseb as a replacement for styrene distillate polymerization inhibitor or wishing to import or sell Dinoseb for the foregoing purpose may use Dinoseb as a replacement after the announcement of this revision, and shall submit a hazard prevention and response plan, complete container, packaging, handling site, and facility markings, make out material safety data sheets , and prepare emergency response tools and equipment within 12 months after the announcement date of this revision. The handler shall make out use records, release quantity records, and regular reports in accordance with regulations starting 12 months after the announcement date of this revision, and shall transport the toxic chemical substance in accordance with regulations. The handler shall submit a release quantity reduction plan, obtain a manufacturing permit, import permit, sale permit, use registration document, storage registration document, or handling license in accordance with regulations, implement hazard prevention and response measures, provide the hazard prevention and response plan to the public for reference, and complete assignment of professional technical management personnel starting 18 months after the announcement date of this revision.

  12. EPA announcements EPA Tu-Tzu No. 0083982 of December 24, 1999, EPA Tu-Tzu No. 0083979 of December 24, 1999, EPA Tu-Tzu No. 0083983 of December 24, 1999, EPA Tu-Tzu No. 0083967 of December 24, 1999, and EPA Tu-Tzu No. 0013779 of March 15, 2000 are no longer applicable.

    2. Example 2: The handled quantity of sodium cyanide containing at least 1% w/w (inclusive) cyanide ions is less than the minimum controlled limit when the total volume (not including plating tank plating liquor) is less than 500 kilograms.

  7. The quantity under 5 tons of toluene diisocyanate and 2,4- toluene diisocyanate used in ambient temperature processes at temperatures below 25°C shall be the handled volume.
  8. A user of a toxic chemical substance who handles less than the minimum controlled limit (not inclusive) and who has obtained the approval of the local competent authority shall not be subject to the restrictions of articles 8, 11, 16, and 17 of this Act.
  9. Apart from reporting use records, release quantity records, and relevant toxicological data (including material safety data sheets and toxic chemical substance accident prevention data sheets) in accordance with regulations, and complying with articles 23, 29, 33, and 34 of this Act, a handler of Class 4 toxic chemical substances shall not be subject to the other restrictions of this Act.
  10. Toxicity classification: 1 indicates a Class 1 toxic chemical substance, 2 indicates a Class 2 toxic chemical substance, 3 indicates a toxic chemical substance, and 4 indicates a Class 4 toxic chemical substance.
  11. The Chinese names in this table shall take precedence; English names, molecular formulas, and CAS numbers are for reference only.
