Revision of Enterprises in Article 9 of the Soil and Groundwater Pollution Remediation Act
Article 9 of the Soil and Groundwater Pollution Remediation Act.
The enterprises in Article 9 of the Soil and Groundwater Pollution Remediation Act and their definitions are as listed in Attached Table 1.
The pollutant items to be tested by the enterprises in the foregoing paragraph are as listed in Attached Table 2.
An enterprise that does not use and does not produce any of the pollutant items to be tested in Attached Table 2 in its actual operations shall attach verification documents, and shall be exempt from testing for those pollutant items after receiving the approval of the competent authority with local jurisdiction. If an enterprise may have used or produced any control items prescribed in the Soil Pollution Control Standards, but not included among the test items in Attached Table 2, in its actual operations or past operations, the enterprise shall add testing for those items.
An enterprise shall perform sampling for site soil pollution tests prior to the following times:
Establishment: sampling shall be completed prior to the trial operation period of a factory or facility, and shall be completed prior to construction when excavation, site leveling, or alteration of landforms occurs.
Sampling shall be completed prior to suspension or termination of business.
The sampling for soil pollution testing in the foregoing paragraph shall be completed within six months before reporting to the competent authority with local jurisdiction for reference. The case shall not be subject to this restriction, however, if the competent authority with local jurisdiction grants approval.
An enterprise shall submit site soil pollution test data to the competent authority with local jurisdiction for reference before taking any of the following actions:
Establishment: actions concerning lawful implementation of an enterprise establishment license or registration, or application for a business (operating) license.
Suspension or termination of business: lawful suspension or termination of business, cancellation of business license or operating permit, when the enterprise actually terminates operation or discontinues production, manufacturing, or processing, etc.
This Announcement shall take effect on the date of promulgation.

In the table, VOCs include the 13 items of benzene, toluene, ethylbenzene, xylene, carbon tetrachloride, chloroform, 1,2-dicloroethane, 1,2-dichloropropane, cis-1,2-dichloroethylene, trans-1,2-dichloroethylene, trichloroethylene, tetrachloroethylene, and vinyl chloride; SVOCs include the eight items of 1,2-dichlorobenzene, 1,3-dichlorobenzene, 3-3’-dichlorobenzidine, hexachlorobenzene, 2,4,5-trichlorophenol, 2,4,6-trichlorophenol, and pentachlorophenol; pesticides include the eight items of Aldrin, Chlordane, 4,4’-dichlorodiphenyl-triichloroethane DDT) and its derivatives, Dieldrin, Endrin, Heptachlor, Toxaphene, and Endosulfan; TPH indicates total petroleum hydrocarbons; PCBsindicate polychlorinated biphenyls.
If an enterprise on the table possesses equipment for storing petroleum crude oil or liquid petroleum products (including gasoline, diesel, light fuel oil, aviation fuel, kerosene, and fuel oil, etc. listed in the Petroleum Product Determination Guidelines
), the test items shall include at least benzene, toluene, ethylbenzene, xylene and TPH.
