Soil and Groundwater Pollution Control Zone Control Regulations

These Regulations are determined pursuant to Article 14, Paragraph 2 of the Soil and Groundwater Pollution Remediation Act (herein referred to as this Act).

The local competent authority shall officially announce soil and groundwater pollution control zones based on the scope of the soil and groundwater pollution of the sites.

Before officially announcing a pollution control zone the local competent authority may in cooperation with relevant competent authorities and the land user, manager or owner conduct a site inspection to confirm the scope of the control zone.

For officially announced pollution control zones the local competent authority shall survey the pollution control boundaries in accordance with the officially announced zone. When necessary it may install fences and install warning signs in clearly visible places.The land user, manager or owner may not obstruct or refuse this.

The following activities are prohibited within the pollution control zone.

  1. Putting pollutants into soil.
  2. Injecting wastewater and sewage into a groundwater body.
  3. Discharging wastewater and sewage into soil.
  4. Other controlled activities that have been designated and officially announced by the competent authority.

Those that engage in the excavation, refill, temporary storage, and transport of soil or groundwater extraction within a pollution control zone shall submit a clean-up or pollution prevention plan to the competent authorities at all levels and may begin to act only after approval by the competent authorities at all levels.

The clean-up or pollution prevention plan in the foregoing paragraph may be submitted together with the pollution control plan or the pollution remediation plan.The content of the report shall include:

  1. Description of the pollution conditions
  2. The methods of excavation, refill, temporary storage and transport of soil or groundwater extraction.
  3. Pollution prevention policy
  4. Health and safety plan
  5. Emergency response plan

When necessary the local competent authority may restrict personnel from entering a soil pollution control zone.

The following land use activities are prohibited within a soil pollution control zone, but shall not be subject to these restrictions, when each of the competent authorities at issue has consented:

  1. The new construction, expansion, reconstruction or renovation of buildings and facilities that are not necessary due to the remediation plan or pollution control plan.
  2. Activities that are required to carry out an environmental impact assessment in compliance with the Standards for Determining Specific Items and Scope of Environmental Impact Assessments for Development Activities
  3. Other land use activities that have been designated by the central competent authority as affecting the health and living environment of residents.

Within a groundwater pollution control zone the local competent authority may prohibit the drinking or use of groundwater.

Article 9 [繁體中文]

The managers of water supply wells within groundwater pollution control zones shall every quarter sample and analyze the pollutant concentrations of said wells and submit them to the local competent authority for future reference.

When necessary, it may prohibit the growing of designated agricultural crops, the raising of poultry or livestock, the cultivating or harvesting of marine animals and plants within the control zone.

The implementation matters of control plans or remediation plans approved pursuant to this Act may not be subject to these Regulations.

These regulations shall take effect on the date of promulgation.
