Regulations Governing General Waste Recycling, Clearance and Disposal

Chapter 1 General Principles [TOC][繁體中文]

Article 1 [繁體中文]

These Regulations are determined pursuant to Article 12, Paragraph 1 of the Waste Disposal Act (herein referred to as the Act).

Article 2 [繁體中文]

Terms used in these Regulations are defined as follows:

  1. Bulk garbage means large discarded furniture, branches and tree trimmings from gardens or general waste as officially announced by the competent authority.

  2. Resource garbage means general waste recyclables (excluding kitchen waste) pursuant to Article 5, Paragraph 6 of the Act and general waste that is produced after the consumption or use of regulated recyclable articles pursuant to Article 15, Paragraph 2 of the Act or the packaging and containers thereof.

  3. Hazardous garbage means general waste meeting the Standards for Defining Hazardous Industrial Waste and officially announced by the central competent authority.

  4. Kitchen waste means discarded uncooked or cooked foodstuffs and the residue or organic waste thereof; and general waste officially announced by the central competent authority.

  5. General garbage means general waste other than bulk garbage, resource garbage, hazardous garbage and kitchen waste.

  6. Sorting means separating general waste of the same category and properties from other waste during storage, recycling, clearance and disposal.

  7. Storage means putting general waste in a specially designated place, storage container or storage facility prior to recycling, clearance and disposal.

  8. Storage containers means vehicles, boxes, tanks, receptacles, bags and other containers specified by the enforcement authority for the storage of general waste.

  9. Discharge means the taking away of general waste from households or other non-industrial establishments (for treatment or disposal).

  10. Recycling means sorting and collecting resource garbage, bulk garbage and kitchen waste contained in general waste.

  11. Clearance means the following acts:

    1. Collection and transport means transporting general waste from the source of generation to the disposal premises (factory) through the use of manpower or clearance and transport machinery.

    2. Transfer means transporting general waste with clearance and transport machinery from the source of generation to a transfer facility or from a transfer facility to an intermediate treatment or final disposal facility.

  12. Transfer facility means a facility that where large amounts of general waste is aggregated before transferring it by way of a large transport vehicle to the disposal premises.

  13. Disposal means the following acts:

    1. Intermediate treatment means treating general waste prior to final disposal or reuse with physical, chemical, biological, thermal, composting or other treatment methods to alter its physical, chemical, or biological characteristics or composition with the aim of achieving separation, neutralization, weight reduction/loss, volume reduction, detoxification, stabilization or rendering the waste harmless.

    2. Final disposal means disposing of general waste in stabilized landfills, sanitary landfills, sealed landfills or by way of marine dumping.

    3. Reuse means using general garbage after physical, chemical or biological processes as materials, fuel, fertilizers, animal feed, fillers, soil enhancers, or for other uses recognized by the central competent authority in consultation with the industry competent authority.

  14. Clearance means storing, recycling, clearing or disposing of general waste.

  15. Thermal treatment methods:

    1. Incineration means treatment methods using high-temperature combustion in order to transform general waste into stable gasses or substances.

    2. Thermal decomposition means treatment methods involving the use of heat to break down general waste under anoxic conditions or in the presence of small quantities of oxygen into a gas, liquid, or residue.

    3. Melting means treatment methods involving the heating of general waste or residue until it reaches the melting point to cause weight reduction, volume reduction, detoxification, stabilization and render the waste harmless.

    4. Other thermal treatment methods.

  16. Continuous feed incineration facility means integrated facilities that move, mix, and burn general waste that is continuously fed into an incinerator, and discharge ash. Such facilities, depending on their method of operation, shall be divided into the two following facility types:

      Total continuous feed incineration facility is a facility that operates 24 hours per day.

      Quasi continuous feed incineration facility is a facility that operates intermittently 16 or more hours per day.

  17. Batch feed incineration facility means integrated facilities that move, mix, and burn general waste that is fed into an incinerator in batches, and discharge ash, with a daily operating time of eight hours in principle.

  18. Ash means fly ash collected by the exhaust gas treatment system during the incineration process of general waste and bottom ash from the incinerator bed.

  19. Loss on ignition means the weight loss of bottom ash that is dried to constant weight and then heated in a high-temperature furnace for three hours at temperatures of 575–625°C as a percentage of its original weight before heating.

  20. Stabilization method means treatment methods involving the use of chemicals mixed or reacting with general waste to cause the general waste to stabilize or become less harmful.

  21. Measuring equipment means equipment that weighs and records general garbage at recycling, storage, clearance, and disposal facilities.

  22. Compost treatment method means methods to decompose organic matter in general waste using the biochemical effects of microbes under controlled conditions to turn the waste into stable humus or soil enhancers.

  23. Stabilized landfilling method means treatment methods involving the placement of general waste in a landfill equipped with facilities or measures to prevent land slippage and subsidence and conserve soil and water.

  24. Sanitary landfilling method means treatment methods involving the burial of general waste in a landfill constructed of water-impermeable materials or low water permeability soil and equipped with leachate and waste gas collection and treatment facilities and groundwater monitoring devices.

  25. Sealed landfilling method means treatment methods involving the burial of hazardous waste in a landfill constructed of pressure-resistant, double-layer water-impermeable materials and equipped with devices that block the outward leakage of pollutants and monitor groundwater.

  26. Marine dumping method means treatment methods involving the transport of waste for dumping, emission or disposal at sea pursuant to the Marine Pollution Control Act.

Equipment shall be used or measures shall be taken to prevent waste from airborne dispersion, splashing, spilling, leaking and polluting the environment.

Article 4 [繁體中文]

When general waste disposal has resource recycling benefits, the disposal facility owners shall establish resource recycling facilities in accordance with competent authority regulations.

Article 5 [繁體中文]

General waste shall be consigned for recycling, clearance or disposal in accordance with these Regulations as well as in accordance with the sorting, collection time, designated locations and methods of clearing and transporting officially announced by the enforcement authority.

Article 6 [繁體中文]

The enforcement authority, public and private waste clearance and disposal organizations, or those approved by the central competent authority pursuant to Article 14, Paragraph 2 of the Act for the clearance and disposal of general waste shall comply with the relevant rules under these Regulations.

Enforcement authorities that handle the recycling, storage, clearing or disposal of regulated recyclable waste pursuant to the Act shall handle them in accordance with these Regulations.

Households and other non-industrial establishments that commission public and private waste clearance and disposal organizations with the clearance and disposal of waste shall commission public and private waste clearance and disposal organizations that have been approved by the competent authority for the clearance and disposal of the said type of waste with its clearance and disposal.

Recycling and disposal enterprises that recycle, store, clear and dispose of regulated recyclable waste pursuant to the Act shall be subject to the various recycling, storage, clearance and disposal method and facility standards for regulated recyclable waste stipulated in Article 18 of the Act and shall not be subject to these Regulations.

Chapter 2 General Waste Clearance [TOC][繁體中文]

Section 1 Sorting, Storage and Discharge [TOC][繁體中文]

Article 7 [繁體中文]

The storage of general waste shall comply with the following regulations:

  1. Storage sites, containers and facilities shall be kept clean, intact and in good condition.

  2. There may be no airborne release, fugitive emissions or leakage of material, no pollution of the ground surface, and no diffusion of noxious odors.

Article 8 [繁體中文]

Recycling storage sites for resource garbage shall comply with the regulations of the foregoing article and also comply with the following regulations:

  1. Storage containers and facilities shall be stored separately according to the type of resource garbage contained therein, and marked in Chinese.

  2. Completely sorted resource garbage shall be placed in zoned storage sections.

  3. Necessary measures shall be taken to prevent completely packaged resources garbage from falling, toppling or collapsing in the storage zones.

  4. The name of the enforcement agency resource garbage recycling storage site and the resource recycling mark resource recycling mark shall be placed in appropriate locations.

Article 9 [繁體中文]

General waste storage facilities shall comply with the following regulations:

  1. Equipment or measures shall be installed to prevent the inflow and infiltration of surface water, rainwater and groundwater.

  2. Equipment or measures shall be installed to prevent waste liquids, waste gases, noxious odors produced by the storage facilities from polluting the surface water body, groundwater body, the air and soil.

The storage facilities of resource garbage recycling storage sites shall comply with the regulations of the foregoing article, and also comply with the following regulations:

  1. Waste light sources for recycling shall be stored in a robust zoned storage facility or container that is sufficiently able to prevent non-accidental damage.

  2. Measuring equipment shall be installed to separately record daily the weight of resource garbage based on category. Records shall be preserved for one year for audit purposes.

  3. When there is concern of airborne dispersion of resource garbage, enclosing walls or other wind-break and wind-shielding facilities shall be installed.

  4. Necessary fire prevention equipment shall be installed.

Article 11 [繁體中文]

Facilities that place general waste storage containers outdoors shall comply with the following regulations:

  1. No leakage of sewage.

  2. No occurrence of rotten or noxious odors.

  3. Ability to prevent the infiltration of rain water.

  4. Equipment or measures are in place that can prevent cats and dogs from scavenging for food.

  5. Ability to accommodate general waste clearing operations.

  6. Other regulations designated by the competent authority or enforcement authority.

Article 12 [繁體中文]

Labeling on resource garbage recycling bins installed by enforcement authorities or installed under enforcement authority guidance in public or business premises shall comply with the following regulations:

  1. The recycling mark 資源回收標誌 shall be affixed in an appropriate location at the front of the bin together with the vertically written words 資源回收桶 (Resource Recycling Bin).

  2. Resource recycling bins shall be marked according to resource garbage category.

  3. The agency or unit placing the bin shall be indicate on the side of bins.

Article 13 [繁體中文]

The enforcement authority shall educate the public in locally appropriate ways to discharge of general waste according to the following methods:

  1. First drain liquids off kitchen waste and then package it properly.

  2. Properly package blades, glass shards and other sharp implements in containers or materials that are not easily perforated and mark them accordingly.

  3. Cut and bundle wood and bamboo pieces.

  4. Tightly close garbage bag openings.

  5. Hazardous waste shall be stored and discharged separately.

  6. Sort, store, discharge and recycle resources garbage based on recycling channel.

  7. Other regulations designated by the competent authority or enforcement authority.

Article 14 [繁體中文]

General waste shall be consigned to recycling, clearance and disposal after sorting according to the following methods:

  1. Bulk garbage: The discharge time shall be arranged in conjunction with the enforcement authority or public and private waste clearance and disposal organizations commissioned by the enforcement authority (herein called commissioned organizations). Moreover discharge shall comply with the clearance and disposal methods designated by the enforcement authority.

  2. Resource garbage:

    1. Shall be consigned to resource garbage recycling vehicles of the enforcement authority or commissioned organizations for recycling according to the time, locations and operating methods designated by the enforcement authority.

    2. Shall be thrown into resource recycling bins (boxes, stations) based on the sorting regulations of resource recycling facilities in each area.

    3. Regulated recyclable waste under the Act may voluntarily be consigned to the original seller or be recycled according to its recycling channel.

  3. Hazardous garbage: Shall be consigned to dedicated vehicles of the enforcement authority or commissioned organizations for clearance according to the time, locations and operating methods designated by the enforcement authority.

  4. General garbage:

    1. Shall be consigned to garbage trucks of the enforcement authority or commissioned organizations for clearance according to the time, locations and operating methods designated by the enforcement authority.

    2. Shall be placed inside general waste storage equipment installed by the enforcement authority.

  5. Kitchen waste:

    1. Shall be consigned into kitchen waste recycling storage equipment of the enforcement authority or commissioned organizations according to the time, locations and operating methods designated by the enforcement authority.

    2. Shall be thrown into kitchen waste recycling bins (boxes, stations) based on the sorting regulations of kitchen waste recycling facilities installed by the enforcement authority or with the approval of the enforcement authority.

For those commissioning clearance and disposal pursuant to Article 6, Paragraph 3, households and other non-industrial establishments shall sort garbage based on the sorting items of the foregoing paragraph; and public and private waste clearance and disposal organizations shall mark the storage container or outer packaging with the name of the commissioning party or indentifiable symbols.

Section 2 Clearance [TOC][繁體中文]

Article 15 [繁體中文]

Bulk garbage, hazardous garbage, general garbage and kitchen waste clearance and transport machinery shall comply with the following regulations:

  1. Shall have necessary security alert systems and leak-proof functions and also be regularly cleaned and disinfected to maintain cleanliness.

  2. They shall be regularly serviced to maintain normal operation.

  3. Vehicle body specifications shall comply with the Regulations Governing Road Traffic Safety.

Article 16 [繁體中文]

The recycling vehicles of enforcement agencies or commissioned organizations shall comply with the following regulations:

  1. Have lifting or loading equipment installed.

  2. The vehicle body or carriage shall be marked with the recycling mark recycling mark.

  3. The name of the recycling organization, the recycling service telephone line and the recycling items shall be marked in an appropriate location.

  4. Shall have necessary security alert systems and also be regularly cleaned and disinfected to maintain cleanliness.

  5. Shall be regularly serviced to maintain normal operation.

  6. Vehicle body specifications shall comply with the Regulations Governing Road Traffic Safety.

Article 17 [繁體中文]

The establishment and operation of general waste transfer facilities shall comply with the following regulations:

  1. Transfer facilities shall have control equipment and measures to prevent repeat environment pollution on site.

  2. Transfer facilities shall have disinfection equipment whose installation complies with operating needs on site.

  3. Transfer facilities shall appropriate disaster prevention and emergency response measures on site.

  4. Environmental sanitation shall be maintained inside and outside the transfer facilities during the transfer process.

  5. The operations of transfer facilities shall be recorded daily. Such records shall be preserved for one year for audit purposes.

  6. Other regulations designated by the competent authority.

Article 18 [繁體中文]

When the enforcement authority or the management organization pursuant to Article 11, Paragraph 9 of the Act perform general waste clearance work and its vehicle and machinery are inadequate, it may lease vehicles from a legal transportation company to assist in the clearing of general waste. The leasing agency or organization shall dispatch personnel to escort the vehicles during transport.

The leased vehicles of the foregoing paragraph shall comply with the regulations of Article 15 and Article 16.

Section 3 Disposal [TOC][繁體中文]

Article 19 [繁體中文]

General waste disposal facilities shall comply with the following regulations:

  1. All facilities shall have a strong foundation structure.

  2. The facilities and surfaces that may come into contact with waste shall be constructed from corrosion-resistant materials.

  3. The surrounding area shall have equipment to prevent the inflow of surface water.

  4. All facilities shall have pollution control equipment and anti-corrosion measures.

  5. Other regulations designated by the competent authority.

Article 20 [繁體中文]

Facilities that dispose of general waste by crushing, sorting and compressing shall comply with the regulations of the foregoing article, and also comply with the following regulations:

  1. They shall have fire and explosion prevention and alarm functions.

  2. They shall have equipment or measures for noise and noxious odor prevention as well as for sewage treatment.

  3. Other regulations designated by the competent authority.

Article 21 [繁體中文]

Intermediate treatment facilities for fecal matter and urine shall comply with the regulations of Article 19, and also comply with the following regulations:

  1. Facilities using biochemical treatment shall have equipment for dumping, storage, digestion treatment, supernatant liquid additional treatment, sludge treatment and disinfection.

  2. Facilities using aerobic treatment shall have equipment for dumping, storage, aerobic treatment and supernatant liquid additional treatment.

  3. Facilities using chemical treatment shall have equipment for dumping, storage, chemical dosing, solid liquid separation, neutralization, separated liquid treatment and sludge treatment.

  4. Other regulations designated by the competent authority.

Article 22 [繁體中文]

Fecal matter and urine to be used as fertilizer must undergo sufficient fermentation and decomposition treatment, heat treatment, chemical disinfection treatment or comply with other treatment methods designated by the competent authority or industry competent authority.

The temperature of the heat treatment of the foregoing paragraph must not be lower than 62°C and treatment time must not be less than 15 minutes.

The chemical disinfection treatment of the first paragraph shall be carried out with chemical disinfectants or by using the ozone disinfection method in order to destroy bacteria, parasite eggs, fly eggs and other pathogens.

The disposal of animal cadavers shall comply with the following regulations:

  1. Animal cadavers may not be abandoned or hung up at will.

  2. Animal cadavers shall be cremated in principle, but smaller livestock may be disposed of by burial.

  3. Other regulations designated by the competent authority or industry competent authority.

Article 24 [繁體中文]

General waste incineration treatment facilities and operating methods shall comply with Article 19, and also comply with the following regulations:

  1. Waste feeding facilities must install measuring and inspection equipment and implement inspection measures for waste fed into the plant according to the Regulations Governing the Treatment and Management of General Waste Feed officially announced by the central competent authority.

  2. Fire prevention and ozone treatment equipment must be installed at waste storage tanks and feeding facilities. Storage tanks must possess a leachate collection system.

  3. The combustion gas temperature downstream of the incinerator’s secondary air injection port or at the secondary combustion chamber outlet shall not be lower than an hourly average value of 850 degrees Celsius.

  4. Fly ash from incinerator ash shall be stored and collected separately, and may not be mixed with bottom ash.

  5. Bottom ash loss on ignition shall comply with the following regulations:

    1. Total continuous feed incineration facility:

      1. 5% or lower for facilities with a daily combustion volume of more than 200 tons.

      2. 7% or lower for facilities with a daily combustion volume of less than 200 tons.

    2. 7% or lower for quasi continuous feed incineration facilities with a daily combustion volume between 40 tons and 180 tons.

    3. 10% or lower for batch feed incineration facilities.

  6. All facilities shall have emergency response equipment.

  7. Other regulations designated by the competent authority.

Article 25 [繁體中文]

Facilities that use thermal treatment other than incineration to dispose of general waste shall comply with the regulations of Article 19 and Paragraphs 1, 2, 6, and 7 of the foregoing article.

Article 26 [繁體中文]

Facilities that use composting to dispose of general waste shall comply with the regulations of Article 19, as well as the following regulations:

  1. All facilities shall have equipment or measures for the prevention of surface water flow into the fermentation and decomposing process.

  2. Compost applied on farmland shall be made through rapid composting, during the fermentation process of whcih the core temperature in the compost pile shall remain between 45°C and 70°C and stay above 50°C for at least seven days, and shall also comply with the regulations of the Fertilizer Management Act.

  3. Compost that serves as soil enhancer or is used in horticulture shall be prevented from causing soil or groundwater pollution, and is not subject to the restrictions determined in the foregoing paragraph.

Article 27 [繁體中文]

Fly ash, other than being reused, shall be treated using stabilization, melting or other methods approved by the central competent authority so that the toxicity levels of such fly ash is lower than the Dioxinous Hazardous Industrial Waste Total Toxicity Equivalent Quantity (TEQ) Concentration Standards and the Attached Table 4 Toxic Characteristic Leaching Procedure (TCLP) Leaching Standards of the Standards for Defining Hazardous Industrial Waste prior to final disposal.

Derivatives from the treatment of the foregoing paragraph shall be packaged with appropriate materials to prevent airborne release. The name of the producing unit (plant name and identification number), the date of production and date of shipping from plant (facility), regulatory control number and other administrative data shall be marked in an appropriate place on such packaging.

Every batch of derivatives from the treatment in Paragraph 1 shall undergo one test for dioxine total TEQ as well as TCLP. Should the test results exceed the Dioxinous Hazardous Industrial Waste Total Toxicity Equivalent Quantity (TEQ) Concentration Standards and the Attached Table 4 Toxic Characteristic Leaching Procedure (TCLP) Leaching Standards of the Standards for Defining Hazardous Industrial Waste, the regulations of Paragraph 1 shall apply or the derivatives shall be handled by using the clearance and disposal methods for hazardous industrial waste.

When bottom ash, other than being reused, undergoes final disposal one test for dioxine total TEQ as well as TCLP shall be conducted every quarter. Should the test results exceed the Dioxinous Hazardous Industrial Waste Total Toxicity Equivalent Quantity (TEQ) Concentration Standards and the Attached Table 4 Toxic Characteristic Leaching Procedure (TCLP) Leaching Standards of the Standards for Defining Hazardous Industrial Waste, appropriate remedial measures shall be taken quickly. Before sampling in the following quarter an improvement plan with the following information and documentary proof of compliance with the Standards for Defining Hazardous Industrial Waste following the improvements shall be submitted to the competent authority for future reference:

  1. Analysis of the reasons for exceeding the standards.

  2. Remedial measures taken.

  3. Treatment and disposal methods.

  4. Measures to strengthen monitoring and management.

  5. Other items designated by the competent authority.

Management information records in Paragraphs 2 and 3, and the test reports in Paragraph 4 shall be made, and kept for three years for audit purposes.

Article 27-1 [繁體中文]

The generation, storage, clearance, disposal and reuse of ash and its post-treatment derivatives shall be subject to the regulations of Article 31, Paragraph 1, Item 2 of the Act. They shall be reported online via the Internet to the special municipality, county, or city competent authority.

Clearance and transport machinery for ash and its post-treatment derivatives shall be subject to the regulations of Article 31, Paragraph 1, Item 3 of the Act, and shall be installed with real-time tracking systems and shall maintain normal operation.

Article 28 [繁體中文]

Waste glass, waste ceramics, waste tiles, stone chips (pieces) or other materials designated by the central competent authority contained in general waste may be disposed of in stabilized landfills. Such facilities shall comply with the regulations of Article 19, as well as the following regulations:

  1. A sign shall be erected at the entrance, and shall indicate the waste type, the use deadline, and the manager.

  2. An enclosing wall or obstacles as well as equipment or measures shall be installed to prevent airborne dispersion in the surrounding area.

  3. Preventive measures shall be taken when there is concern of landslip or ground subsidence.

  4. Water and soil conservation measures shall be adopted in accordance with waste characteristics and the landfill topography and geology.

  5. When a landfill ceases to be used, it shall be covered with sand-based or mud-based clay of more than 50 cm in thickness.

  6. Other regulations designated by the competent authority.

Article 29 [繁體中文]

Facilities that use sanitary landfilling to dispose of general waste shall comply with the regulations of Article 19, as well as the following regulations:

  1. A sign shall be erected at the entrance, and shall indicate the waste type, the use deadline, and the manager.

  2. An enclosing wall or obstacles as well as equipment or measures shall be installed to prevent airborne dispersion in the surrounding area.

  3. The structure shall prevent ground subsidence and sinking of the landfill facility.

  4. The bottom layer and periphery of a landfill shall have a water permeability coefficient of less than 10 cm/sec., and shall be compatible with the waste and its leachate. This layer shall have a foundation of sandy or argillaceous clay or equivalent material at least 60cm in thickness, and shall have a lining of artificial water-impermeable materials that have a water permeability coefficient of less than 10-10 cm/sec., are compatible with the waste and its leachate, and are of a thickness of at least 0.2cm.

  5. They shall have leachate collection and treatment facilities.

  6. One monitoring well or more shall be installed upstream and downstream based on groundwater flow direction in the surrounding area of the landfill site.

  7. Fire extinguishers and other fire prevention equipment shall be installed.

  8. They shall have methane collection, treatment or reuse facilities.

  9. Other regulations designated by the competent authority.

Landfills that send away the leachate of Item 5 in the foregoing paragraph after its collection for disposal outside the landfill site may refrain from installing leachate treatment facilities after requesting and receiving approval from a higher competent authority.

Article 30 [繁體中文]

Sanitary landfill operations shall comply with the following regulations:

  1. At the end of every work day, the landfill shall be covered with a layer of sandy soil of more than 15 cm thickness or a sealant of similar effect, which is then compacted. After compacting, the gradient for flat surfaces shall be greater than 1 percent and for sloped surfaces between 15 and 25 percent. Depressions caused by cracks or sinking of buried waste shall be immediately repaired.

  2. When a landfill ceases to be used, it shall be covered with a layer of more than 50 centimeters thickness of sand-based or mud-based clay, bentonite, or a mix of geomaterials or other water-blocking materials of similar water blocking ability. If gravel is used as cover, it shall be compacted. After compacting the gradient for flat surfaces shall be greater than 1 percent and for sloped surfaces less than 30 percent. The landfill shall be planted with vegetation cover.

  3. Other regulations designated by the competent authority.

The enforcement authority shall determine the time of the cover soil operations and record the landfilling process. These records shall be properly preserved until three years after the closure of said site.

The cover soil in Paragraph 1 can be substituted by other efficient methods after the enforcement authority has requested and received approval from a higher competent authority.

When ash is disposed of in a sanitary landfill upon treatment with the stabilization method, it shall be buried in independent zones. The landfill shall also comply with the following regulations:

  1. Facilities shall be installed with independent leachate collection systems and independent zones made from double-layer water-impermeable materials. Separation levees (walls) as well as facilities to prevent slippage and collapse shall also be installed. The landfill shall comply with the regulations of Article 29.

  2. Every quarter the water quality of post-treatment leachate shall be regularly tested. Should it be detected that heavy metal items exceed effluence standards or that there is heavy metal contamination in downstream groundwater monitoring wells, remedial measures shall be taken quickly.

  3. Independent zone landfill treatment areas or proprietary ash landfills are not subject to the restrictions of Article 29, Paragraph 1, Item 8 and Article 30, Paragraph 1, Item 1.

Sanitary landfills whose construction was completed or under way, whose project tender procedures were completed, or whose project contracts were given out and signed prior to the implementation of revisions to these Regulations may collect leachate with the leachate collection system of existing landfills and shall strengthen the prevention of rainwater infiltration. They are not subject to the restrictions of Item 1 of the foregoing paragraph.

Hazardous waste disposed of in a sealed landfill are also subject to the regulations of the Methods and Facilities Standards for the Storage, Clearance and Disposal of Industrial Waste.

The storage and clearance of general waste prior to reuse shall comply with these Regulations.

The categories and management methods for the reuse of general waste shall be publicly announced by the central competent authority in consultation with the reuse central industry competent authority.

General waste reuse other than of the foregoing paragraph may be carried out after the enforcement authority has requested and received approval from the central competent authority pursuant to the regulations of Article 14, Paragraph 2 of the Act.

General waste disposed of by marine dumping shall comply with the regulations of the Marine Pollution Control Act.

Article 36 [繁體中文]

With regard to the regulations of Article 27, Paragraph 2, the enforcement authority shall complete improvements within one year of the implementation of revisions to these Regulations when handling the clearance of general waste.

Article 37 [繁體中文]

The enforcement authority shall be subject to these Regulations when it has been commissioned to clear and dispose of industry-generated resource garbage.

Article 38 [繁體中文]

These Regulations shall take effect on the date of promulgation.
